I <br />I <br />I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> I <br /> I <br />I <br /> I <br /> i <br /> I <br /> I <br /> I <br /> <br />Ms. Orcutt felt that if you can't see the wailer unless you're parked in front of it in the individual's <br />yard, then it should be acceptable. <br /> <br />Commissioner Hendriksen responded that if she appeared before the Planning Commission in that <br />instance, he would find it acceptable. <br /> <br />Ms. Frolik reminded everyone that the reason for this meeting is because there is an ordinance on <br />the books, and since it's been brought to everyone's attention, it needs to be dealt with. However, <br />amending the ordinance takes time. <br /> <br />Mr. Enfield reiterated that he would be very interested in finding a place in the city for parking <br />trailers. <br /> <br />Scott Ritzer, 16451 Armstrong Boulevard N.W. - mentioned that today, a lot of home businesses <br />are being operated and the City needs to start somewhere in dealing with that. He described his <br />location including the trees and berming, advising that he put up a 4,000 square foot building and <br />now he has a $270,000 home he can't use because of the moratorium on these cases. <br /> <br />Ms. Frolik stated that the building permit states 'no commercial use'. <br /> <br />Mr. Ritzer stated that the building inspector informed him that he could get a conditional use <br />permit, however, the City won't accept his application. <br /> <br />Commissioner Handriksen remarked that everything Mr. Ritzer described would be reviewed---the <br />pine trees and berming are the kinds of things routinely done to commercially zoned and operated <br />businesses to mitigate visual impact. Commissioner Hendriksen commented that in an ideal world <br />this case would fall across the line where he would need to do a site plan and would get a <br />conditional use permit. <br /> <br />Mr. Ritzer inquired as to where he could apply since he wants to get this started. He remarked that <br />there will always be people who will complain no matter what. <br /> <br />Commissioner Hendriksen stated that there are people in this city that hate their neighbor, so there <br />is a significant benefit to having the process set down on paper so that you can say you complied <br />with the process. <br /> <br />Ms. Frolik advised that the problem in Mr. Ritzer's case is that he wants to relocate his business at <br />home. A home business requires that business be in the confines of the home. You cannot apply <br />for a home occupation permit if the business is run out of the garage. Mr. Ritzer has signed a <br />building permit that states he is not going to mn a business out of the accessory building. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Thorud that the next time <br />this case is on the agenda it will be the only case on that agenda. <br /> <br />Further Discussion: Commissioner Terry suggested just making it the first item on the agenda. <br />Commissioner Hendriksen disagreed, stating that this issue needs to be dealt with alone. <br />Commissioner Deemer suggested that the Planning Commission could deal with this more <br />efficiently if the residents submitted their comments and suggestions in writing for review prior to <br />the meeting. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Hendriksen, Thorud, <br />Deemer, LaDue, and Terry. Voting No: None.
