I10 The four additional lots created in this Plat will be charged a total of Six Thousand Two Hundred Fifty Two Dollars and no cents ($6,252.00), which sum will be due and payable upon the conveyance by deed or contract for deed of any of the said platted lots. At the time each lot is required to connect to the City's utilities, each lot will be required to pay the then current Metropolitan Wastewater Control Commission Sewer Availability Charge ("SAC") and the City of Rarnsey Water Availability Charge ("WAC"), and any City inspection and installation fee, Estimated Costs. It is understood and agreed that construction cost mounts set forth in this Agreement, unless specified as fixed amounts, are estimated. The DEVELOPER agrees to pay the actual costs, including interest, fmcal engineering and legal charges. II. PERMITS, OCCUPANCY, AND USES Construction Site Maintenance. The DEVELOPER shall adhere to all City ordinances relating to, but not limited to, dumping of garbage, site development, construction debris, open burning, etc. ReqUirements for Building Permits and Certificates of Occupancy. No building permit for any lot in ~e Plat shall be issued until (a) a Certificate of Survey, including that information required by the CITY, has been supplied to the City Building Official; and (b) all the financial obligations required herein by the CITY have been satisfied. No Certificate of Occupancy for any lot in the Plat shall be issued until: (a) the CITY°S municipal sewer system is available for service to the lots as determined by the City Engineer;, and (d) all driveways have been hardsurfaced in accordance with Item g9 of this Agreement. HI. PARK DEDICATION Park D.~lic~fiqn.. The Plat is located in the Sunfish Lake Park District. Park dedication shall be satisfied by the DEVELOPER making a cash payment to the CITY in an amount equal to $825.00 per new lot created, or Three Thousand Three Hundred Dollars and no/ cents ($3,300.00) (4 x.$825.00). Said sum shall be paid to the CITY prior to the Final Plat being released for recording. IV. GENERAL Transportation Impact Fee. The CITY has determined that it is appropriate to implement a transportation impact fee on new development that would not exceed Five Hundred DolIars ($500.00) per .lot. If that fee system is enacted by April 15, 1996, the DEVELOPER herein agrees that this Plat shall be subject to said fee. Tree and Sod. Plant[ne Plan. Sodded boulevards are a requirement for each lot in the Plat prior to issuance ot~ a Certificate of Occupancy. In accordance with. the policy established by the City of Ramsey Park and Recreation Commission on June 10, 1993, the DEVELOPER shall provide for the planting of one two-inch diameter tree (or equivalent thereof) of an approved species at the road frontage or in the front yard of each of the lots in the Plat prior to the issuance of a Certificate of Occupancy. In the event the weather is not conducive to tree or sod planting at'the time of Certificate of Occupancy, the DEVELOPER shall place a cash deposit in the amount of $200.00 for trees and $100.00 for sod in an escrow account with the CITY and upon verification of the planting being I I I I I I I I I I I I I I I I I I I
