CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br /> <br />DEVELOPMENT AGREEMENT - GREEN ADDITION <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF <br />RAMSEY, a municipal corporation of the State of Minnesota (the "CITY"), and lAMES A. <br />GREEN AND SHARON Y. GR~N, husband and wife, whose address is 5858 151st Lane <br />N.W., Ramsey, Minnesota, hereinafter referred to as the "DEVELOPER." <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owner of thc following described property <br />situated in the City of Ramsey, Anoka County, Minnesota and legally described as follows: <br /> <br />Lot 2, Block 2, HAUBRICH ADDITION, Anoka County, Minnesota; <br /> <br />or upon reco~g: <br /> <br />Lots 1, 2, 3, 4 and 5, Block 1, GREEN ADDITION, Anoka County, Minnesota <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, on January 23, 1996, pursuant to Resolution g96-01-.. , the CITY <br />approved the final plat of the Subject Property which plat is known as GREEN ADDITION (the <br />"Plat") contingent on certain requirements, including DEVELOPER and CITY entering into this <br />contracg and <br /> <br /> WHEREAS, the Plat consists of five (5) lots which is a resubdivision of Lot 2, Block 2, <br />Haubrich Addition; and <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05; entitled "Minor Plat Procedure"; and <br /> <br /> WHEREAS, a trunk usage charge is required by the CITY for usage of its Trunk Sewer <br />and Water System; which charge is $1563.00 per residential unit created; and <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until the City Code escrow <br />requirements have been fulfilled by DEVELOPER. <br /> <br />NOW THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Dedication of' Drainaee and UtilRv Easements. Draiaage and utility easement shall <br />be dedidated to the CITY as shown on the Final Plat. <br /> <br />Trunk and Lateral Sewer and ~Vater Fees. The DEVELOPER agrees to pay the <br />current One Thousand Five Hundred Sixty Three Dollar and no/cent ($1,563.00) trunk <br />sewer and water charge for each of the residential lots in the Plat, aa this charge is required <br />of all lots receiving access to the sewer and water system. The sewer and water Irunk fees <br />for the existing homestead will be assessed under Improvement Project g95-14. <br /> <br /> <br />
