Mark Nagel brought to the Commissions attention that there should be been a change in the employee evaluation form, however, Mark asked that there be a motion to approve the current' form and it be used for O'Connell's annual review. Motion was made by Cotten, seconded by Peterson TO ACCEPT SCHROEDER REPORT AND SET THE EMPLOYER CONTRIBUTION TO BENEFITS AT $210/MONTH FER FOR F.T. EMPLOYEE AND TO INCREASE PROGRAM PRODUCERS WAGES BY 3%. 8 ayes - 0 nays. motion carried. ATTORNEY'S REPORT- 7 7.1 TRANSFER OF OWNERSHIP Creighton informed the Commission that once the FCC form 394 has been received from Meredith there is a 120 day period to prepare for thetransfer of ownership. The 120 days were to analyze the technical, legal, and financial ability of operator. The FCC from 394 should answer most, if not, all questions regarding the transfer of ownership. If the City Councils have questions they may also present them along with the FCC form. Creighton also stated that all fees incurred are. required by franchise to be reimbursed by operator and that it should take 2 to 3 months to finish work required in the transfer. 7.2 RENEWAL Creighton stated that he hasn't had much time to work on the renewal and that there has been some struggle developing a municipal specific telecommunication ordinance. He has a meeting with the League of Minnesota Cities in February to further discuss this ordinance. 7.3 RATE REGULATION Creighton asked to have a motion passed to give the Chair authority to sign the Rate Order he has drafted and will send to the Administrator for execution. The FCC form's 1210 - 1205, submitted by Meredith, are in compliance with FCC regulations. Motion was made by Schroeder, seconded by Peterson TO AUTHORIZE CHAIR TO SIGN RATE ORDER BEING SENT BY CREIGHTON. 8 ayes - 0 nays. Motion carried.
