14. <br /> <br />15. <br /> <br />Hard Surfaced Driveways. Hard surfaced driveways are arequirement for each lot in <br />the Plat, including the pre-existing homestead. The DEVELOPER herein agrees to accept <br />responsibility for the installation of a hard surface driveway at the site of the pm-existing <br />homestead. For all other lots, said improvement shall be installed by the building permit <br />applicant or the homeowner at the time the Certificate of Occupancy is issued or as soon <br />thereafter as possible, weather permitting. In the event this improvement is not timely <br />installed, the DEVELOPER, on behalf of all subsequent owners of lots within the Plat, <br />agrees that the CITY may install said improvement on any lot and specially assess its cost <br />therefore against the lot. The DEVELOPER hereby waives all fight to a public hearing <br />and other statutory rights or City Charter fights granted a property owner relating to special <br />assessments, including the right to appeal the special assessment for installation of the <br />improvement described in this paragraph. In addition, the DEVELOPER grants the fight <br />to the CITY to enter on each lot of the Plat in order to install the improvement described in <br />this paragraph, in the event it is necessary for the CITY to install this improvement and <br />specially assess the same. <br /> <br /> III. <br />PERMITS, OCCUPANCY AND PROPERTY VALUES: <br /> <br />Requirements for Buil0ing and Occupancy Permits. No building permit for any <br />lot in the Plat shall be issued until: (a) reasonable vehicular access to the lot is provided; <br />(b) a Certificate of Survey, including that information required by the CITY, has been <br />supplied to the City Building Official; and (c) al/the financial guarantees required by the <br />CITY have been satisfied. No occupancy permit shall be issued for any lot in the plat <br />until: (a) vehicular access to the lot is provided including the installation of Class V <br />material on all streets in the Plat; and (b) all utilities are in place, operational and accepted <br />by the CITY. <br /> <br />Furthermore, during the installation and for a period of I2 months following acceptance by <br />the CITY, any damage to the Improvements shall be repaired at the cost of the <br />DEVELOPER if the CITY is unable to otherwise identify the source of the damage. <br /> <br /> IV <br />PARK DEDICATION: <br /> <br /> I <br /> I <br /> i <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I' <br />I <br />I <br />I <br />I <br /> <br /> <br />
