14. 15. Hard Surfaced Driveways. Hard surfaced driveways are arequirement for each lot in the Plat, including the pre-existing homestead. The DEVELOPER herein agrees to accept responsibility for the installation of a hard surface driveway at the site of the pm-existing homestead. For all other lots, said improvement shall be installed by the building permit applicant or the homeowner at the time the Certificate of Occupancy is issued or as soon thereafter as possible, weather permitting. In the event this improvement is not timely installed, the DEVELOPER, on behalf of all subsequent owners of lots within the Plat, agrees that the CITY may install said improvement on any lot and specially assess its cost therefore against the lot. The DEVELOPER hereby waives all fight to a public hearing and other statutory rights or City Charter fights granted a property owner relating to special assessments, including the right to appeal the special assessment for installation of the improvement described in this paragraph. In addition, the DEVELOPER grants the fight to the CITY to enter on each lot of the Plat in order to install the improvement described in this paragraph, in the event it is necessary for the CITY to install this improvement and specially assess the same. III. PERMITS, OCCUPANCY AND PROPERTY VALUES: Requirements for Buil0ing and Occupancy Permits. No building permit for any lot in the Plat shall be issued until: (a) reasonable vehicular access to the lot is provided; (b) a Certificate of Survey, including that information required by the CITY, has been supplied to the City Building Official; and (c) al/the financial guarantees required by the CITY have been satisfied. No occupancy permit shall be issued for any lot in the plat until: (a) vehicular access to the lot is provided including the installation of Class V material on all streets in the Plat; and (b) all utilities are in place, operational and accepted by the CITY. Furthermore, during the installation and for a period of I2 months following acceptance by the CITY, any damage to the Improvements shall be repaired at the cost of the DEVELOPER if the CITY is unable to otherwise identify the source of the damage.
