Ms. Walte Smith called an Employee Assistance
Program (EAP) and two of the City's three health care providers and they all agreed that this type
of evaluation is considered a third party referral and is not covered by health insurance or HMO
contracts. Therefore, the City or the employee would have to pay the costs, including the $250 for
the ~mnal consultation and a monthly fee for momtormg until u:eatment ~s completed. Treatment is
not provided by theper mn/organization doing the evaluation and is usually covered by health
insurance. The EAP representative suggested that paying' for the evaluation should be a
consequence the employee experiences for not complying with the policy. Ms. Walte Smith
recommended that .the City Council amend the policy to specify the employee would pay for that
referral. She added that every employee subject to the policy received a copy of it and that later she
met with the Publi~ Works staff so they could ask any questions they might have.

Motion by Councilmember Beahen and seconded by Mayor Hardin to reconmaend that City
Council amend the Federal Omnibus Transportation Employee Testing Act and Related Regulations

Personnel Committee/February

13, 1996
