Ms. Frolik replied there is no restriction against anyone storing vehicles for someone else on their <br />property. <br /> <br />Councilmember Zimmerman suggested that Ms. Williams has some good points but we have come <br />a long way and we need to go forward with this and maybe take this up at a future date. He <br />summarized Ms. Williams requests - took at changes in the urban area and if the property owner <br />could have someone else store their commercial vehicle on their property. He suggested that <br />maybe the City could stipulate that a person has to live at his residence for a certain amount of time <br />before a commercial vehicle can be stored on that property. <br /> <br />Ms. Williams felt that this was a different train of thought than what she was referring to. She <br />suggested limiting parldng in the urban area. Excess cars would have to be parked next to the <br />driveway or garage versus the back of their 80 foot lot. <br /> <br />Councilmember Zimmerman stated that was brought up before but there was not enough support <br />of the idea. <br /> <br />Ms. Williams stated that the City could be less strict for the larger lots. In the urban services area, <br />we could restrict storage next to the garage or on the driveway or on some type of prepared <br />surface. She inquired if that would be feasible. <br /> <br />Mr. Goodrich replied that it would be feasible. We would need a findings of fact as to why we <br />think.a certain area should be more or less restrictive. We would need to have criteria that would <br />stand up in court <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beahen to send the <br />proposed amendments of-Chapters 5 and 9 back to the Planning Commission for a possible <br />amendment which would incorporate more restrictive rules for the Urban Service Area by having <br />storage limited to the driveway or next to the garage, on a prepared surface. <br /> <br />Further discussion: Mayor Hardin felt that these suggestions should be looked at for the entire <br />City. Ms. Frolik stated that the Planning Commission felt that out in the rural area, there may be <br />an area that's more conducive to screening. Ail vehicles have to be. on. a prepared surface; <br />however, private use equipment does not have to be on a prepared surface. She added that if there <br />is any kind of amendment on this, we need.another public hearing. Counc/lmember Zimmerman <br />suggested passing this and then working .together to suggest more changes. Mayor Hardin stated <br />there are some other issues such as year-round screening. Councilmember Beyer inquired about <br />the public hearing to which Attorney Goodrich stated that if there is a substantial change, a public <br />hearing would have to be held. Councilmember Beyer suggested that Mayor Hardin should have <br />gotten his. comments to the Planning Commission. Councilmember Zimmerman stated that we <br />have been discussing this for close to a year. Councilmember Peterson noted that the Planning <br />Commission considered this but they did not have the 'legal advice necessary to act on this. He <br />stated he is just asking for their opinion - he feels it' would be worth it. He suggested that the <br />Planning Commission review this, give input and then it should come back to the City Council to <br />determine if the changes warrant a public hearing. <br /> <br />Motion carried.
