Absent: CouncilmemberBeahen. <br /> <br />Case #3: <br /> <br />Request for Preliminary Plat Approval of Fox Knoll 2nd Addition; <br />Case of Residential Development, Inc. <br /> <br />City Engineer Jankowski stated that Residential Development, Inc. is requesting preliminary plat <br />approval of Fox Knoll 2nd Addition. This property is located in the southeast comer of- the <br />intersection of Sunfish Lake Boulevard and 153rd Avenue. The plat proposes 44 single family <br />units. The access onto Sunfish Lake Boulevard has been approved by the County Highway <br />Department All lots will receive access from interior streets. As requested by Mr. Kurak, the <br />adjacent property owner, 151st Lane will terminate in a cul-de-sac at the south property boundary. <br />Staff recommended extending Sodium Street north to intersect with 153rd. The developer <br />presented evidence at the Planning Commission meeting that the topography and grades are such <br />that there would be significant impact to existing trees and the grades adjacent to the existing <br />homestead. Staff put the developer on notice that certain upgrades would be required to make the <br />pre-existing structure more compatible with the new neighborhood. However, the developer has <br />no control or ownership of the homestead parcel which has a life estate for the existing resident. <br />Mr. Jankowski suggested that Council may wish to control the proximity of lots to be final platted <br />to the homestead. At a minimum, he recommended that a bituminous driveway to the existing <br />garage be required. With regard to pedestrian trails, it was anticipated that at some point in the <br />future there may be a need for an On-Road "B" trail along Sodium Street NW to 153rd Avenue. <br />To facilitate, this possibility, the developer is being required to provide curb cuts at 152nd and <br />151st and an easement from the northerly terminus of Sodium Street to 153rd. The developer will <br />also be required to continue the pedestrian trails along Sunfish Lake Boulevard and 153rd Avenue. <br />Park dedication will be satisfied with a cash contribution. The Planning Commission conducted a <br />public hearing and they, and staff, are recommending approval of the preliminary plat. <br /> <br />Mayor Hardin inquired if there has been any conversation with the developer as it relates to the <br />present homestead. <br /> <br />Rick Murray, Residential Development, stated that the life estate goes to Mrs. Scroggins. They <br />intend to remodel, reside, pave, etc. It will look modernized but will maintain its charm. There <br />will be a buffer plus all owners will be notified of the home. <br /> <br />John Bertleson, John Oliver & Associates, showed the road connection and stated that projecting <br />the street straight through presents a problem with.the life estate. The slopes are at a height of <br />elevation to make it difficult to go out to the street. ' <br /> <br />Mr. Murray stated that the grading plan was designed originally to keep the trees and so very little <br />grading would have to be done. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Hardin to approve the preliminary pat <br />plan without access to 153rd for Fox Knoll 2nd Addition. <br /> <br />Further discussion: Councilmember Zimmerman stated it seems to be a lot of traffic out to Sunfish <br />Lake Boulevard but then it is saving some trees. He just wasn't sure it was a good idea but <br />guessed he could support it since the Planning Commission approved it. <br /> <br />Motion carried.
