Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-03- <br /> <br />A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A <br />REQUEST FROM GOOD VALUE HOMES, INC. FORA-X--'CONDITIONAL USE <br />PERMIT TO GRADE AND EXPORTS SOILS <br /> <br /> WHERI~AS, the City of Ramsey received an application from Good Value Homes, Inc. <br />for a conditional Use permit to grade and export excess soils from the property legally described as <br />follows: <br /> <br />The Nort3 Half of the Northwest Quarter of Section 27, Township 32, Range 25, Anoka <br />County, l~linnesota, EXCEPT the following described tract: <br /> <br />That part of the Northwest Quarter of the Northwest Quarter of said Section 27 described <br />as follows: Commencing at the Southwest comer thereof; thence north 00 degrees 33 <br />minutes 4~7 seconds West on the West line of said Northwest Quarter of the Northwest <br />Quarter f~r a distance of 418 feet; thence North 89 degrees 26 minutes 44 seconds East and <br />parallel w~th the South line of said Northwest Quarter of the Northwest Quarter a distance <br />of 209 fe6t; thence South 00 degrees 33 minutes 47 seconds East and parallel to said West <br />line to the~'said South line thereof; thence South 89 degrees 26 minutes 44 seconds West on <br />said SouR line to the point of commencement. Except Parcel No. 8, Anoka County <br />Highway Right-Of-Way Plat No. 16. <br /> <br />Also including that part of the Southeast Quarter of the Northwest Quarter of said <br />Northwes[ Quarter lying northeasterly of Anoka County Highway Right-of-Way Plat no. <br />8. <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the <br />findings of fact', relating to the request are determined to be as follows: <br /> <br />o <br /> <br />That on January 4, 1996, Good Value Homes, Inc., hereinafter referred to as "Applicant", <br />properly applied for a conditional use permit to grade and export excess soils from the <br />proposed plat of Pondview, which plat received preliminary plat approval from the City <br />Council or~ March 12, 1996. <br /> <br />That the applicant appeared before the Ramsey Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the City Code on April 2, 1996, and that said public hearing <br />was prope~.ly advertised and that the minutes of said public hearing are hereby incorporated <br />as a part of._ these findings by reference. <br /> <br />That a majOr portion of the ~ubject property has been approved by the Ramsey City Council <br />for rezoni~g from Industrial to R-1 Urban Residential, is approximately 85 acres in size <br />and is prol~sed to be developed with 148 single family lots. <br /> <br />That the Applicant has submitted a gr~rling plan dated December 15, 1995, prepared by <br />Passe Engineering, Inc. <br /> <br />That the Applicant is proposing to export approximately 120,000 yards of earth material. <br /> <br /> <br />
