Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #96-03- A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST FROM GOOD VALUE HOMES, INC. FORA-X--'CONDITIONAL USE PERMIT TO GRADE AND EXPORTS SOILS WHERI~AS, the City of Ramsey received an application from Good Value Homes, Inc. for a conditional Use permit to grade and export excess soils from the property legally described as follows: The Nort3 Half of the Northwest Quarter of Section 27, Township 32, Range 25, Anoka County, l~linnesota, EXCEPT the following described tract: That part of the Northwest Quarter of the Northwest Quarter of said Section 27 described as follows: Commencing at the Southwest comer thereof; thence north 00 degrees 33 minutes 4~7 seconds West on the West line of said Northwest Quarter of the Northwest Quarter f~r a distance of 418 feet; thence North 89 degrees 26 minutes 44 seconds East and parallel w~th the South line of said Northwest Quarter of the Northwest Quarter a distance of 209 fe6t; thence South 00 degrees 33 minutes 47 seconds East and parallel to said West line to the~'said South line thereof; thence South 89 degrees 26 minutes 44 seconds West on said SouR line to the point of commencement. Except Parcel No. 8, Anoka County Highway Right-Of-Way Plat No. 16. Also including that part of the Southeast Quarter of the Northwest Quarter of said Northwes[ Quarter lying northeasterly of Anoka County Highway Right-of-Way Plat no. 8. (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact', relating to the request are determined to be as follows: o That on January 4, 1996, Good Value Homes, Inc., hereinafter referred to as "Applicant", properly applied for a conditional use permit to grade and export excess soils from the proposed plat of Pondview, which plat received preliminary plat approval from the City Council or~ March 12, 1996. That the applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on April 2, 1996, and that said public hearing was prope~.ly advertised and that the minutes of said public hearing are hereby incorporated as a part of._ these findings by reference. That a majOr portion of the ~ubject property has been approved by the Ramsey City Council for rezoni~g from Industrial to R-1 Urban Residential, is approximately 85 acres in size and is prol~sed to be developed with 148 single family lots. That the Applicant has submitted a gr~rling plan dated December 15, 1995, prepared by Passe Engineering, Inc. That the Applicant is proposing to export approximately 120,000 yards of earth material.
