,I <br /> I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> i <br /> <br />CONSIDER JOINT POWERS AGREEMENT BETWEEN THE CITY OF ANOKA AND <br />THE CITY OF RAMSEY FOR THE SUPPLY OF MUNICIPAL WATER SERVICE TO <br />PORTIONS OF THE CITY OF RAMSEY <br /> By: Jessie Hart, Finance Officer and Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />During 1994, the City of Ramsey constructed a water interconnect with the City of Anoka in an <br />attempt to relieve:the demand placed on the City of Ramsey during peak usage times during the <br />year. It was intended that this interconnect would be in the best interest of both cities as the City <br />of Anoka has resOrve municipal water system capacity above that which is needed to supply its <br />peak day demand and provide Ramsey with a secondary emergency water source. <br /> <br />During 1995, the !City of Ramsey purchased in excess of 24.5 million gallons, or 18% of the <br />utilities total annual water, from the City of Anoka. During the peak use summer month of July <br />1995, the utility Was supplied with 6.8 million gallons, or 30% of its total water, from Anoka. <br />Based on this consumption, it is evident that the City of Ramsey relies heavily on the water <br />supplied by the City of Anoka. It has been calculated by City Engineer Steve Jankowski that, <br />even with the enhancements to well #1 and late-1996 addition of well #3, the City of Ramsey <br />will still rely heavily on excess capacity that the City of Anoka has to offer to meet its peak day <br />demand in the sunimer of 1997. <br /> <br />The initial agreerOent, which was never signed by both cities, was a basic Memorandum of <br />Understanding [Attachment 1] that put on paper the understanding and responsibilities of both <br />cities. This agreement, other than water rates which are reviewed annually, was to be <br />reconsidered in five years, or in 1999. The attached Joint Powers Agreement [Attachment 2] <br />serves this same purpose and is being presented for your review and consideration. <br /> <br />Observations: <br /> <br />The attached Joint Powers Agreement has yet to be reviewed by City Attorney Bill Goodrich. A <br />copy along with the case will be forwarded for his review and comment. <br /> <br />Staff observations:is that the content is similar in nature to the previous Memorandum of <br />Understanding and-provides a certain amount of protection for both parties involved. Several <br />areas of exception are as follows: <br /> <br />3. Sale of Woter <br /> Included in this section under (a) is a provision that gives Anoka the opportunity <br /> to reduce or eliminate the amount of water sold to Ramsey with a 9 months <br /> written notice. Anoka has sole discretion in determining if an emergency <br /> situation or unusual condition exists ~ without any input from the City of Ramsey. <br /> <br /> <br />
