,I I '1 I I I I I I I I I I I I I I I I 10. 11. 12. 13. 14. 15. 16. 17. 18 Prior to commencing any grading operations, the City Engineer and the Permit Holder's engineer Shall have resolved the drainage issue along Andrie Street N.W. and a modified grading plan shall be submitted for the record accordingly. Prior to commencing any grading operations, a cash escrow or letter of credit approved as to form by the City in the amount of Seven Thousand Five Hundred Dollars ($7,500.00) shall be d~posited with the City. This financial guarantee may be used by the City to pay for the co~.t and expense of repairing any public right of ways due to the mining operation, pay for MY cost associated in administering the requirements of this Chapter of the City Code, and to pay for any restoration of the worksite not properly restored upon completion. The Permit Holder shall implement sediment and erosion control practices. No grading activity shall occur within twenty-five (25) feet of a property line unless silt fence is placed along the ~roperty line to prevent sediment from washing onto the adjoining property. Any erosion which causes gullies of greater than one (1) foot within twenty-five (25) feet of a property li~e shall be regraded within forty-eight (48) hours of the precipitation event that caused the erosion. There shall be no stockpiling of graded materials, other than the topsoil on a temporary basis, allowed within the boundaries of the P.U.D. The permit holder shall file with the City a liability insurance policy or certificate of such insurance [acceptable to the City and issued by an insurance company authorized to do business in the State of Minnesota. a. The policy shall insure the permit holder for the sum of at least $300,000 for injury to one person and $500,000 for one accident, and at least $1,100,000 property damage. bo Said policy shall be for the full period of the permit and shall provide for the giving of 10 days prior notice to the City by registered mail of termination, cancellation or amendment of the policy. In the event said policy is terminated for any reason, the permit shall be automatically suspended upon the day the policy terminates unless a new policy complying with this item is 'obtained and filed with the City prior to the termination of the policy in force. The maximum noise level at the perimeter of the worksite shall be within the limits set by the Minneaota Pollution Control Agency and the Environmental Protection Agency of the United States. All costs incurred by the City in executing and administering this permit shall be the responsibility of the permit holder. The permit holder shall maintain a minimum Five Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall be used to reimburse the City for expenses incurred in the administration of this permit. At the time the grading operation and site restoration are completed to the satisfaction of the City, the balance of the escrow shall be returned to the Permit Holder. All grading operations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays only unless otherwise specifically approved by the City Administrator and/or his designee. The amount of dust or other particulate matter caused by the mining operation shall not exceed the ~tandards established by the Minnesota Pollution Control Agency. No operation shall be allowed when wind gust exceed 30 miles per hour. qq
