Councilmember Bcyer ntroduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION NO. 95-07-148 <br /> <br />A RESOLUTION DECLARING TERMS OF CONDITIONAL USE PERMIT, <br />BASED ON FINDINGS OF FACT /fl}380, TO GRADE SOILS <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 95-07-147 adopting <br />Findings of Fact g0380 for this use and herein approves the Conditional Use Permit subject to the <br />following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On July 11, 1995, a Conditional Use Permit ("CUP") was issued by the City of Rarnsey ("City") <br />to North Fork, Inc. ("Permit Holder") for grading operations on the property legally described as <br />follows: <br /> <br /> Lots 5, 6, 7 and 8, Block 3, NORTH FORK LINKS ADDITION, Anoka County, <br />Minnesota. <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />This permit shall expire on September 30, 1995 and the expiration date shall apply to all <br />grading and restoration operations. <br /> <br />All grading shall be in conformance with the grading plan dated June 29, 1995 and <br />prepared by Ulteig Engineer's, Inc. <br /> <br />All equipment used for grading operations shall be maintained and operated in such a <br />manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. <br />All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed <br />from the worksite regularly. <br /> <br />All worksites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the worksite. <br /> <br />5. Existing tree and groundcover shall be preserved to the extent feasible. <br /> <br />o <br /> <br />Grading operations shall be conducted in such a manner to minimize interference with the <br />surface water drainage outside the boundaries of the operation. <br /> <br />No grading operations shall occur at below an elevation of 6 feet above the elevation of the <br />water table on the worksite. <br /> <br />o <br /> <br />Fencing may be ordered by the City Council or City Engineer anytime the permit is in force <br />and shall be installed within 24 hours of written notice. <br /> <br />o <br /> <br />All access roads to and from the Subject Property shall be maintained in order to minimize <br />dust. <br /> <br /> <br />
