I <br /> <br />I <br />'1 <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> i <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />CASE <br /> <br />REQUEST FOR AN AMENDMENT TO CONDITIONAL USE PERMIT; <br /> CASE OF ALLOY RECOVERY COMPANY <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Alloy Recove~ Company established an aluminum processing facility at 7060 142nd Avenue <br />N.W. by a conditional use permit issued by the City in 1991. Alloy has applied for a conditional <br />use permit to enlarge the facility with a 9,000 square foot addition to the principal building on the <br />site. <br /> <br />Notification: <br /> <br />State Statute requires notification to all property owners within 350 feet of the subject property. <br />Staff attempted to notify all property owners north to the AEC facility, west to Ramsey Blvd., <br />south to Hwy. #10 and east to the Bury and Carlson site of the public hearing conducted by the <br />Planning Commission on March 4. <br /> <br />Observations:. <br /> <br />The existing facili. 'ty consists of a 2,100 square foot operations building and a 1,920 square foot <br />structure in whi0h the melt furnace is housed. The applicant is proposing to increase the size of the <br />principal buildir~g to 11,100 square feet in order to get more of the operations into an enclosed <br />building. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />f) <br /> <br />site location map <br />site plan <br />proposed findings of fact <br />c ~¢-rent/proposed conditional use penrdt <br />Planning Commission public hearing and regular meeting minutes dated <br />March 4, 1996 <br /> <br />The City Administrator, City Engineer, Parks Supervisor, and Zoning Administrator visited the <br />site on Tuesday, ~February 20, 1996. The Zoning Administrator has also been in commtmication <br />with the Minnesdta Pollution Control Agency and the Anoka County Environmental Services. The <br />following determlnafions were made in response to the cunent conditional use permit terms: <br /> <br />I. Items//3 (Dust/Ash/Particulates) and Item//5 (Smoke): Staff had a telephone conversation <br />with Rhonda Jol!anson in the Enfomement Unit of the PCA. It seems that there was not an Ak <br />Quality Permit in effect for the subject site and Alloy Recovery has made application for same. <br />Rhonda indicated that she inspectec[ the site on September 19, 1995 and the facility appeared to be <br />in compliance. MPCA review staff was given a deadline of April 4, 1996 to respond to the <br />application. Ms. ~Johanson has indicated that if she receives no responses from the review staff by <br />April 4, she inte_~ds to issue an air quality permit to Alloy Recovery. Alloy Recovery will be <br />issued what is ca~4ed an Option D Regulatory Pemait because their emissions are very low. As <br />long as Alloy opa~rates under the emission caps established in the Option D permit, they can make <br />changes to their i'acility without filing for. a new permit. Also because of their Iow emissions <br />levels, they are 'not subject to annual inspections unless PCA receives complaints about the <br />operation. <br /> <br /> <br />
