2. Item ~h5 (Furnace Emissions and Monitoring): Alloy has not complied with the requirement <br />to conduct an annual emissions test and provide the City with a copy of the report. The Planning <br />Commission reviewed this issue and determined that it is not necessary for the City to be mom <br />strict than MPCA. The Planning Commission has proposed mending Item #6 of the Conditional <br />Use Permit to require Alloy to provide the City with copies of any inspections repons or tests <br />performed at the site by regulator agencies. <br /> <br />3. Item #11 (Liquid Waste/HaT.ardous Wastes): In checking with Anoka County <br />Environmental Services, Staff was informed that Alloy had not registered with them for a <br />determination as to whether or not they require a hazardous waste generator license. On March 5 <br />Alloy fled the necessary paperwork at Anoka County. Staff received verbal confirmation on April <br />3, 1996 from Dave Harmon at Anoka County that based on the information provided, Alloy is not <br />required to have a hazardous waste generators license. Item #9 of the Findings of Fact should be <br />amended accordingly. <br /> <br />4. Item #12 (Storage of Received Materials, Feedstock, Separated Materials, and Equipment): <br />Exterior storage of materials has gone beyond the 30' x 50' area behind the building and is <br />occurring on the total site. Mr. Schwartzman has assured the Planning Commission that the <br />mount of enclosed space provided with the building expansion will enable him to comply with the <br />30' x 50' outside storage restriction. <br /> <br />5. Item #18: (Ash or Dross): It was clarified that the residue from the smelting operation is <br />dross; not ash; all references to ash in the conditional use permit were changed to dross. The dross <br />is being stored in one or two semi-trailers parked at the loading dock rather than in a building. As <br />the trailers fill up, their contents are transferred to the shipper's axiler and transported off the site. <br />The Planning Commission felt that the intent of the CUP is to prohibit storage of dross in a manner <br />conducive to leaching into the groundwater and an enclosed trailer meets that intent. The Planning <br />Commission proposes that the conditional use permit be amended to allow for storage of dross in <br />trailers. The previous limit of no more than 35 tons of dross being stored on the site at any one <br />time remains in affect" <br /> <br />6. Item #25 (Water Quality): Staff has been provided with a copy of Alloy's Permit No. MN <br />G610000 to discharge stormwater associated with industrial activity issued by the Water Quality <br />Division of MPCA. <br /> <br />7. Item #26 (Screening): There is a substantial amount of outside storage occurring and it is <br />visible from 142nd, Ramsey Blvd., and Hwy. #10. As mentioned earlier, Mr. Schwartzman has <br />stated that the building expansion will enable him to confine outside storage to a 30' x 50' area <br />behind the building that will not be visible from the roadways. <br /> <br />8. Item #35 (Fire Lanes): It is staff's opinion that because of outside storage, clear fire lanes <br />are not being maintained in the work yard. This too should be remedied with the construction of <br />the additional indoor space. <br /> <br />9. Item #36 (Contingency Action Plan): Alloy has not filed a contingency action plan with the <br />City. The Fire Chief has been asked to follow up on this. <br /> <br />I0. Item #38 (Trailer/Vehicle Storage): Staff noticed two or three trailers on the site. Alloy <br />indicates that these trailers are used to store dross and residual recyclables until shipping is <br />warranted. As mentioned earlier, the Planning Commission has recommended amending the <br />conditional use permit to allow for this use of trailers on the property. <br /> <br />11. Item #42 (Work and Storage Operations Enclosed): Requiring all operations and storage to <br />be in an enclosed building conflicts with Item #26 that requires screening of outside storage and <br />Item #12 that' limits outside storage to a 30' x 50' area.
