Hard surfaced driveways are a requirement for each 1Et <br />in the Plat. Said improvement shall be installed by the building permit applicant or <br />the homeowner at the time the Certificate of Occupancy is issued or as soon <br />thereafter as possible, weather permitting. In the event this improvement is not <br />timely installed, the DEVELOPER, on behalf of all subsequent owners of lots <br />within the Plat, agrees that CITY may install said improvement on any lot and <br />specially assess its cost therefore against the lot. The DEVELOPER hereby <br />waives ali right to a public hearing and other statutory rights or City Charter rights <br />granted a property owner relating to special assessments, including the right to <br />appeal the special assessment for installation of the improvement described in this <br />paragraph. In addition, the DEVELOPER grants the right to the CITY to enter <br />on each lot of the Plat in order to install the improvement described in this <br />paragraph, in the event it is necessary for the CITY to install this improvement and <br />specially assess the same. <br /> <br />III. PERMITS AND OCCUPANCY <br /> <br />Requirements for Occupancy Permits. No occupancy permit for any lot in the Plat <br />shall be issued until: (a) vehicular access to the lot is provided including the <br />installation of Class V material on all streets in the Plat; (b) site plan approval is <br />granted by the CITY and amy additional expense incurred in giving site plan <br />approval has been reimbursed to the CITY; (c) a Certificate of Survey, including <br />that information required by the CITY, been supplied to the City Building Official; <br />(d) a tree planting has been accomplished in accordance w/th Item #15 of this <br />Agreement; and (e) all the financial guarantees required by the CITY have been <br />satisfied. <br /> <br />IV. PARK DEDICATION <br /> <br />Cash and Trail Development. The Plat is located in the Marble Park District. Park <br />dedication requirements shall be satisfied by a combination of tra/I development and <br />cash payment. As a Stage I Improvement, the DEVELOPER shall dedicate and <br />pave an eight (8) foot w/de bituminous path along the east boundary of the Plat at ~ <br />grade not to exceed 5%. Non-wetland ~,fil property ,Mil be credited at a rote of Ten <br />ThousandDollars and no/cents ($10,000) per acre and trail construction will be <br />credited at Seven Dollars and no/cents ($7.00) per lineal foot against the Thirty <br />Seven Thousand Nine Hundred Fifty Dollars and no/cents ($37,950) due the CITY <br />for park dedication (46 lots x $825.00). The non-wetland area of the trail corridor <br />is estimated at 3.68 acres for a credit of $36,800 (3.68 acres x $10,000/acre). The <br />iineal distance of the trail is estimated at 2,300 feet for a credit of $16,100.00 <br />(2,300 feet x $7.00/foot).
