TRANSPORTATION AND LANDSCAPING <br /> <br />Transportation Impact Fee. The CITY has enacted a Transportation Impact Fee in <br />the amount of Five Hundred Dollars ($500.00) per lot. The amount Of <br />Transportation Impact Fee due on the Plat is Twenty Three Thousand. Dollars <br />($23,000.00). The DEVELOPER has the option to either:. (a) Pay the entire <br />amount due prior to the CITY releasting the Plat for recording at the County; or <br />(b) Pay fifty percent of the Transportation Impact Fee ($11,500.00) prior to the <br />CITY; releasing the Plat for recording and divert the remaining $11,500.00 due as <br />an ad~tional $250.00 fee on each building pemait issued in the Plat. The amourit <br />of thc DEVELOPER'S share of the Transportation Impact Fee due shall be <br />credited for construction of the transportational trail described in Item #16 of this <br />Agreoment in the amount of Eight Thousand Four Hundred Seventy Dollars and no <br />cents ~{$8,470.00) (1;210 lineal feet x $7.00 per foot). The minimum amount of <br />TransPortation Impact Fees due from the DEVELOPER is Three Thousand and <br />Thirty Dollars and no cents ($3,030.00), if the remaining 50% or $11,500.00 is to <br />be collected on building pen-nit fees. <br /> <br />Transportation Trail. The DEVELOPER shall construct and pave' in accordance <br />with CITY standards, a ten (10) foot wide bituminous trail not to exceed 5% in <br />gradel parallel to C.S.A.H. #116 from Hematite Street N.W. to Sunwood Drive. <br />There shall be a minimum of ten (10) feet between the edge of the .trail pavement <br />and the adjacent property lines. The DEVELOPER shall provide approved turf <br />establishment in conjunction with the trail construction within the subject Plat. The <br />construction of this transportational trail shall be credited against the Transportation <br />Impa~t Fee due on the Plat in the amount of Eight Thousand Four Hundred Seventy <br />Dollars and no cents Dollars ($8,470.00) (1,210 lineal feet x $7.00 per foot). <br /> <br />Tree and Sod Planting Plan. Sodded boulevards are a requirement for each lot in <br />the Plat prior to issuance of a Certificate of Occupancy. In accordance with City <br />Code and the policy established by the City of Ramsey Park and Recreation <br />Commission on June 10, 1993, the DEVELOPER is required to submit a <br />Land,ape Plan for CITY approval that identifies existing tree growth within the <br />Plat that will be preserved during construction and new plantings. It is: herein <br />agreed that the requirement for a Landscape Plan shall be fulfilled by the <br />DEVELOPER as follows: <br /> <br />a) MinimizNg the impact of construction on trees in accordance with Minnesota <br />ExtenSion Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR-FO-6135-S). <br /> <br />b) Phhting one two-inch diameter tree (or equivalent thereof) of an approved <br />species at the road frontage or in the front yard of each of the lots in the Plat prior to <br />the issuance of a Certificate of Occupancy. In the event the weather is not <br />conducive to tree or sod planting at the time of Certificate of Occupancy, the <br />Building Permit holder shall place a cash deposit in the amount of $200.00 for trees <br />and $100.00 for sod in an escrow account with the CITY and upon verification of <br />the pl .anting being accomplished, said cash deposit shall be refunded to the Building <br />Permit holder. Failure of the Builder to comply with the planting requirement <br />within- a reasonable time frame following a determination by the CITY that weathei <br />conditions are conducive to planting shall give the CITY authority to cause the <br />planting, the cost of which shall be charged to the escrow account and the Builder <br />shall not be eligible for a refund of the cash deposit made for this purpose. <br /> <br /> <br />
