The CITY has enacted a Transportation Impact Fee in the amount of Five Hundred Dollars ($500.00) per lot. The amount Of Transportation Impact Fee due on the Plat is Twenty Three Thousand. Dollars ($23,000.00). The DEVELOPER has the option to either:. (a) Pay the entire amount due prior to the CITY releasting the Plat for recording at the County; or (b) Pay fifty percent of the Transportation Impact Fee ($11,500.00) prior to the CITY; releasing the Plat for recording and divert the remaining $11,500.00 due as an ad~tional $250.00 fee on each building pemait issued in the Plat. The amourit of thc DEVELOPER'S share of the Transportation Impact Fee due shall be credited for construction of the transportational trail described in Item #16 of this Agreoment in the amount of Eight Thousand Four Hundred Seventy Dollars and no cents ~{$8,470.00) (1;210 lineal feet x $7.00 per foot). The minimum amount of TransPortation Impact Fees due from the DEVELOPER is Three Thousand and Thirty Dollars and no cents ($3,030.00), if the remaining 50% or $11,500.00 is to be collected on building pen-nit fees. Transportation Trail. The DEVELOPER shall construct and pave' in accordance with CITY standards, a ten (10) foot wide bituminous trail not to exceed 5% in gradel parallel to C.S.A.H. #116 from Hematite Street N.W. to Sunwood Drive. There shall be a minimum of ten (10) feet between the edge of the .trail pavement and the adjacent property lines. The DEVELOPER shall provide approved turf establishment in conjunction with the trail construction within the subject Plat. The construction of this transportational trail shall be credited against the Transportation Impa~t Fee due on the Plat in the amount of Eight Thousand Four Hundred Seventy Dollars and no cents Dollars ($8,470.00) (1,210 lineal feet x $7.00 per foot). Tree and Sod Planting Plan. Sodded boulevards are a requirement for each lot in the Plat prior to issuance of a Certificate of Occupancy. In accordance with City Code and the policy established by the City of Ramsey Park and Recreation Commission on June 10, 1993, the DEVELOPER is required to submit a Land,ape Plan for CITY approval that identifies existing tree growth within the Plat that will be preserved during construction and new plantings. It is: herein agreed that the requirement for a Landscape Plan shall be fulfilled by the DEVELOPER as follows: a) MinimizNg the impact of construction on trees in accordance with Minnesota ExtenSion Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO-6135-S). b) Phhting one two-inch diameter tree (or equivalent thereof) of an approved species at the road frontage or in the front yard of each of the lots in the Plat prior to the issuance of a Certificate of Occupancy. In the event the weather is not conducive to tree or sod planting at the time of Certificate of Occupancy, the Building Permit holder shall place a cash deposit in the amount of $200.00 for trees and $100.00 for sod in an escrow account with the CITY and upon verification of the pl .anting being accomplished, said cash deposit shall be refunded to the Building Permit holder. Failure of the Builder to comply with the planting requirement within- a reasonable time frame following a determination by the CITY that weathei conditions are conducive to planting shall give the CITY authority to cause the planting, the cost of which shall be charged to the escrow account and the Builder shall not be eligible for a refund of the cash deposit made for this purpose.
