Hard surfaced driveways are a requirement for each lot <br />in the Plat. Said improvement shall be installed by the building .permit applicant or <br />the homeowner at the time the Certificate of Occupancy is issued or as soon <br />thereafter as possible, weather permkfing, In the event this improvement is not <br />timelY installed, the DEVELOPER, on behalf of ail subsequent owners of lots <br />within the Plat, agrees that CITY may instal/said improvement oh any lot and <br />Speclally assess its cost therefore against the lot. The DEVELOPER hereby <br />waives all right to a public hearing and other statutory rights or City Charter rights <br />granted a property owner relating to special assessments, including the right .to <br />appeal the special assessment for installation of the improvement described in this <br />paragraph. In addition, the DEVELOPER grants the right to the CITY to enter <br />on e, ach lot of the Plat in order to install the improvement described in this <br />para~a_.ph, in the event it is necessary for the CITY to install this improvement and <br />spectally assess the same. . <br /> <br />III. PERMITS AND OCCUPANCY <br /> <br />Requirements for Occupancy Permits. No occupancy permit for any lot in the Plat <br />shall, be issued until: (a) vehicular access to the lot is provided including the <br />installation of Class V material on all streets in the Plat; (b) site plan approval is <br />granted by the CITY and any additional expense incurred in giving site plan <br />approval has been reimbursed to the CITY; (c) a Certificate of Survey, including <br />that information required by the CITY, been supplied to the City Building Official; <br />(d) a tree planting has been accomplished in accordance-with Item #15 of this <br />Agreement; and (e) all the financial guarantees required by the CITY have been <br />satisfied. <br /> <br />IV. PARK DEDICATION <br /> <br />Park Dedication. The Plat is located in the Sunfish Lake Park District. Park <br />dedidation requirements shall be satisfied by a cash payment. The cash payment <br />due to the CITY for park dedication is Thirty Six Thousand Three Hundred Dollars <br />and no cents ($36,300.00). ' <br /> <br />V. TRANSPORTATION AND LANDSCAPING <br /> <br />Transportation Impact Fee. The CITY has enacted a Transportation Impact Fee in <br />the mount of Five Hundred Dollars ($500.00) per lot. The amount of <br />Transportation Impact Fee due on the Plat is Twelve Thousand' Five Hundred <br />Dollars ($22,000.00). These funds are intended to facilitate the cont/unation of <br />Sunwood Drive, an east/west collector in the area, and bridging the wetland. The <br />DEVELOPER has the option to either: (a) Pay the entire amount due prior to the <br />CITY releasting the Plat for recording at the County; or (b) Pay fifty percent of <br />the Transportation Impact Fee ($11,000.00) prior to the CITY releasing the Plat <br /> <br /> <br />
