16. <br /> <br />17. <br /> <br />18. <br /> <br />for recording and divert the remaining $11,000.00 due as an additional $250.00 fee <br />on each building permit issued in the Plat. The amount of the DEVELOPER'S <br />share of the Transportation Impact Fee due shall be credited for construction' of the <br />transpormtional trail described in Item #16 of this Agreement in the amount of <br /> Dollars ($ ). <br /> <br />Trail. The DEVELOPER shall construct and pave in accordance with CITY <br />standards, an off-road trail not to exceed 5% in grade, parallel to Potassium Street <br />N.W. from Sunwood Drive south to 146th Avenue N.W. The DEVELOPER <br />shall provide approved turf establishment in conjunction with the trail construction. <br /> <br />Tree and Sod Planting Plan. Sodded boulevards are a requirement for each lot in <br />the Plat prior to issuance of a Certificate of Occupancy. In accordance with City <br />Code and the policy established by the City of Ramsey Park and Recreation <br />Commission on June 10, 1993, the DEVELOPER is required to submit a <br />Landscape Plan for CITY approval that identifies existing tree growth within the <br />Plat that will be preserved during construction and new plantings. It is herein <br />agreed that the requirement for a Landscape Plan shall be fulfilled by the <br />DEVELOPER as follows: <br /> <br />a) Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR-FO-6135-S). <br /> <br />b) Planting one two-inch diameter tree (or equivalent thereof) of an approved <br />species at the road frontage or in the front yard of each of the lots in the Plat prior to <br />the issuance of a Certificate of Occupancy. In the event the weather is not <br />conducive to tree or sod planting at the time of Certificate of Occupancy, the <br />Building Permit holder shall place a cash deposit in the amount of $200.00 for trees <br />and $100.00 for sod in an escrow account with the CITY and upon verification of <br />the planting being accomplished, said cash deposit shall be refunded to the Building <br />Permit holder. Failure of the Builder to comply with the planting requirement <br />within a reasonable time frame following a determination by the CiTY that weather <br />conditions are conducive to planting shall give the CITY authority to cause the <br />planting, the cost of which shall be charged to the escrow account and the Builder <br />shall not be eligible for a refund of the cash deposit made for this purpose. <br /> <br />Tree Disease Prevention and Disposal. The DEVELOPER shall prevent the <br />introduction and spread of tree disease into the residual tree populations of the Plat <br />and adjoining properties and reduce the impacts of construction on the residual <br />property of the Plat and adjoining properties. The DEVELOPER in order to <br />accomplish in accordance with "Protecting Trees From Construction Damage" shall: <br /> <br />a) .Install physical barriers, such as snow fence, around trees that are to remain. <br />The fencing shall be located at the dripline of these remaining trees. <br /> <br />b) Insure that alt equipment operators will have readily available, a tree wound <br />dressing and will apply it immediately to damaged oak trees if wounding occurs <br />from ApriI 15 through July 15. <br /> <br />c. Insure that trees will only be skidded against other trees that are to be removed. <br />Trees in the middle twenty (20) feet of a road easement will be removed first, with <br />remaining trees to be skidded toward the middle of the road easement.
