I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT - TRANBY TERRACE 2ND ADDITION <br /> <br />THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a <br />municipal corporation of the State of Minnesota (the CITY"), and DAVID M. TRANBY and <br />KATHY B. TRANBY, husband and wife, whose address is 17230 Tiger Street N.W., Ramsey, <br />Minnesota ("the DEVELOPERS"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPERS are the fee owners of the following described property <br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described <br />as follows: <br /> <br />Lots 1,2 and 3, Block 1, TRANBY TERRACE 2ND ADDITION, Anoka County, <br />Minnesota' <br /> <br />the "Subject Property"; and <br /> <br /> WHEREAS, on August 13, 1996, pursuant to Resolution g96-08- the CITY <br />approved the finalr plat of the Subject Property which plat is known as TRANBY 'TERRACE <br />2ND ADDITION (the "Plat") contingent on certain requirements, including DEVELOPERS <br />and CITY entering into this agreement; and <br /> <br />WHEREAS, the Plat consists of three (3) lots totalling approximately 29.7 acres; <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (Subd. 2) entitled "Division or Consolidation of Unplatted Lots". <br /> <br /> WItEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have 'been fulfilled by the DEVELOPER. <br /> <br />NOW, TItEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. All lots within the plat shall have access onto Tiger Street N.W. <br /> <br />Drainage and Utility Easements. The standard drainage and utility easements around <br />the perimeter of each of the two lots shall be dedicated to the CITY on the Final Plat <br /> <br />Resubdivislon Restrictions. Under 4 in 40 density restrictions, it is herein agreed that <br />lots 1, 2, and 3 of the Plat will not be eligible for further resubdivison until sanitary sewer <br />and municipal water are available to the Subject Property or the repeal or reduction of the 4 <br />in 40 density restrictions. <br /> <br /> <br />
