I <br /> <br />CASE # <br /> <br />REQUEST FOR AN INTERIM USE PERMIT FOR A TEMPORARY <br />STRUCTURE; CASE OF JOHNSON HOLDINGS, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />Earlier this summer, Johnson Holdings, Inc. received site plan approval to construct and <br />operate a bank on the former public works site. Johnson Holdings has submitted an <br />application fo~ an interim use permit to utilize a 14' x 60' modular office structure at 14150 <br />St. Francis Bl~d. N.W. The temporary structure would be used for the conduct of bank <br />business whil~ the permanent structure is under construction. <br /> <br />The following <br /> <br />a) <br />b) <br />c) <br /> <br />d) <br />e) <br /> <br />Notification: <br /> <br />items are enclosed for your information: <br /> <br />Site location map <br />Site plan <br />Planning Commission public hearing and regular meeting minutes dated <br />August 6, 1996 <br />Findings of Fact//0408 <br />Proposed interim use permit <br /> <br />In accordance with State law, Properties within 350 feet of the subject property were <br />notified of the public hearing conducted by the Planning Commission on August 6. <br /> <br />Observations: <br /> <br />Because of numerous requests from residents and local businesses, Johnson Holdings is <br />requesting the u{e of a modular office structure for a 4 to 6 month period in order to begin <br />business operations on the site while their permanent building is under construction. The <br />City has previously granted perm/ts for temporary office structures in the commercial and <br />industrial areas for limited periods of time to accommodate the particular needs of the <br />businesses. <br /> <br />At the public hearing on August 6, comments were submitted to the Planning Commission <br />that granting such a permit 'would give the Landmark Bank an unfair business advantage <br />over the new ban}c on the east side of T.H. #47. The Planning Commission recommended <br />approval of the request. <br /> <br />On August 27, 1996, the request was submitted to City Council for approval and positive <br />findings of fact Were adopted, but the motion to approve the request failed. Staff was <br />directed to place the case on the next Council agenda for reconsideration. <br /> <br />Findings of Fact//0408 adopted by City Council on August 27 are positive. If the Council <br />is inclined to deny the request on September 9, then the previous Findings of Fact 0408 <br />should be rescinded. Council should then take action to amend and adopt a negative <br />findings of fact. <br /> <br />Recommendation: <br /> <br />The Planning Commission and City Staff recommend approval of the interim use permit. <br /> <br /> <br />
