and agrees that no filling of wetlands will take place in conjunction with this development. <br />The DEVELOPER agrees to inform the purchaser of the created lots in writing that no <br />filling can legally occur into the drainage and utility easements which have been established <br />by the Plat to define and protect the wetland areas. <br /> <br />Boulevard and Area Restoration, The DEVELOPER shall be responsible for the <br />cost of establishing seed or sod in all boulevards within thirty (30) days of the completion <br />of the street improvements, and restoring all other areas disturbed by the development <br />grading operation in accordance with the approved erosion and sediment control plan. The <br />DEVELOPER shall also be responsible for the cost of cleaning any soil, earth or debris <br />from the wetlands within and adjacent to this Plat resulting from grading performed in the <br />development of the land. <br /> <br />Requirements After Street Surfacing. The DEVELOPER shall clear any soil, <br />earth, or debris from the street and from the lots within the Plat resulting from any <br />construction on the Subject Property by the DEVELOPER or their successors and <br />assigns. <br /> <br />Lateral Sanitary Sewer 0nd W~¢ermain Benefit. Sanitary sewer and water were <br />previously installed in 149th Lane in conjunction with utility extensions to the Amber Ridge <br />and Willow Ridge subdivisions, however, individual lot services were not stubbed out. <br />These utilities also provide service to the land north of 149th Lane N.W. The <br />DEVELOPER agrees to pay fifty (50) percent of the cost of an eight (8) inch sanitary <br />sewer main, including appurtenances, from 150th Lane N.W. to T.H. #47. The <br />DEVELOPER agrees to pay fifty (50) percent of the cost of one thousand (I,000) feet of <br />eight (8) inch watermain. <br /> <br />Since service laterals were not stubbed out for these lots, the CITY agrees to credit the <br />DEVELOPER the actual cost of dewatering for th~se laterals as well as the actual cost of <br />stubbing out additional laterals to accommodate future services on the north side of 149th <br />Lane N.W. The unit prices used to determine the above lateral benefit shall be those used <br />from the Ramsey Meadows 2nd Addition and Sunfish Square Addition. The amount of <br />lateral benefit is agreed to be Twenty Nine Thousand Dollars ($29,000.00). <br /> <br />Credit For The Paving of 149th Lane N.W.
