H a rd S u? fa ced D r ivewa vs. Hard surfaced driveways are a requirement for each lot in <br /> the Plat. Said improvement shall be installed by the building permit applicant or the <br /> homeowner at the time the Certificate of Occupancy is issued or as soon thereafter as <br /> possible, weather permitting. In the event this improvement is not timely installed, the <br /> DEVELOPER, on behalf of all subsequent owners of lots within the Plat, agrees that the <br /> CITY may install said improvement on any lot and specially assess its cost therefore <br /> against thelot. The DEVELOPER hereby waives all right to a punic hearing and other <br /> statutory r~ghts or City Charter rights granted a property owner relating to special <br /> assessments, including the right to appeal the special assessment for installation of the <br /> improvement described in this paragraph. In addition, the DEVELOPER grants the right <br /> to the cITY to enter on each lot of the Plat in order to install the improvement described in <br /> this paragraph, in the event it is necessary for the CITY to install this improvement and <br /> specially assess the same. <br /> <br /> III. <br />PERMITS, OCCUPANCY AND PROPERTY VALUES: <br /> <br />17. <br /> <br />.Requirem6nts for Building Permits. No occupancy permit for any lot in the Plat <br />shall be issued until: (a) site plan approval is granted by the CITY and any additional <br />expense incurred in giving site plan approval has been reimbursed to the CITY; (b) a <br />Certificate of Survey, including that information required by the CITY, has been supplied <br />to the City BOilding Official; and (c) all the f'mancial guarantees required by the CITY have <br />been satisfied. <br /> IV. <br /> PARK DEDICATION: <br /> <br />18. Cash Cont~ribution. The Subject Property is in the Prairie Park District. Park <br /> dedication shall be satisfied by a cash contribution in the amount of Three Thousand Three <br /> Hundred Dollars and no/cents ($3,300.00) which represents $825.00 for each of the four <br /> <br />lots. <br /> <br />19.
