the amount of Five Hundred Dollars ($500.00) per lot. The mount of Transportation Impact Fee due on the Plat is Two Thousand Dollars and no cents ($2,000.00). These funds are intended to facilitate the instMIation of traffic signals at the intersections of i42nd Avenue N.W. and Xldmo Street N.W. with T.H. #4?. The DEVELOPER has the option to either: (a) Pay the entke amoutn due prior to the CITY releasing the Plat for recording at the County; or (b) Pay fifty percent of the Transportation Impact Fee ($1,000.00) prior to the CITY releasing the Plat for recording and divert the remaining $I,000.00 due as an additional $250.00 fee on each building permit issued in the Plat. 20. Tree and Sod Planting Plan. Sodded boulevards are a requirement for each lot in the Plat prior to issuance of a Certificate of Occupancy. In accordance with City Code and the · policy established by the City of Ramsey Park and Recreation Commission on June 10, I993, the DEVELOPER is required to submit a Landscape Plan for CITY approval that identifies existing tree growth within the Plat that will be preserved during construction and new plantings. It is herein agreed that the requirement for a Landscape Plan shall be fulfilled by the DEVELOPER as follows: Minimizing the impact of construction on trees in accordance with Minnesota Extension Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO-6135-S). b) Planting one two-inch diameter tree (or equivalent thereof) of an approved species at the road frontage or in the front yard of each of the lots in the Plat prior to the issuance of a Certificate of Occupancy. In the event the weather is not conducive to tree or sod planting at the time of Certificate of Occupancy, the Building Permit holder shall place a cash deposit in the amount of $200.00 for trees and $100.00 for sod in an escrow account with the CITY and upon verificatio'n of the planting being accomplished, said cash deposit shall be refunded to the Building Permit holder. Failure of the Builder to comply with the planting requirement within a reasonable time frame following a determination by the CITY that weather conditions are conducive to plantin~ shall give the CITY authority to cause the planting, the cost of which shall be charged to the escrow account and the Builder shall not be eligible for a refund of the cash deposit made for this purpose. 21.Tree Disease Prevention and Disposal.
