I <br /> <br /> I <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br /> DEVELOPMENT AGREEMENT <br /> HARMONY FARM <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF <br />RAMSEY, a municipal corporation of the State of Minnesota (the "CITY"), and, GERALD J. <br />BAUER and HEIDI BAUER, whose address is 5750 177th Avenue N.W., Ramsey, <br />Minnesota, ("the DEVELOPER"). <br /> WlTNE$SETH: <br /> <br /> WHEREAS, the DEVELOPER and Barbara Scottston are the fee owners of the <br />following described property situated in the CITY OF RAMSEY, County of Anoka, State of <br />Minnesota, and legally described as follows: <br /> <br />Lot 1, Block 1; Lots 1, 2, and 3, Block 2; Outlots A, and C; Harmony Farm, Anoka <br />County, Minnesota; <br /> <br />the "Subject Property"; and <br /> <br /> WHEREAS, on October 22, 1996, pursuant to Resolution 96-10- , the CITY <br />approved the finM plat of the Subject Property which plat is known as HARMONY FARM (the <br />"Plat") contingen~t on certain requirements, including DEVELOPER and CITY entering into this <br />contract; and <br /> <br /> WHEREAS, the final plat for the Subject Property conforms to the sketch plan for <br />Harmony Farm approved by the Planning Commission on October 1, 1996, and <br /> <br /> WHEREAS, the DEVELOPER herein attests to the fact that there are wetlands existing <br />on the Subject PrOperty; and <br /> <br /> WHEREAS, no expenditure of CITY funds, will be made until the City Code escrow <br />requirements have been fulfilled by DEVELOPER; and <br /> <br /> WHERtgAS, City Code Section 9.50.50 defines "Stage I" Improvements and "Stage II" <br />Improvements which definition is used herein when reference is made to "Stage I" and "Stage 11" <br />Improvements; and <br /> <br /> WHEREAS, the DEVELOPER desires to provide for the Stage II improvements, except <br />for those Stage II Improvements constructed by the CITY. <br /> <br />77 <br /> <br /> <br />
