I I I I I I I I I I I I I I I CITY OF RAMSEY ANOKA COUNTY, MINNESOTA DEVELOPMENT AGREEMENT HARMONY FARM THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a municipal corporation of the State of Minnesota (the "CITY"), and, GERALD J. BAUER and HEIDI BAUER, whose address is 5750 177th Avenue N.W., Ramsey, Minnesota, ("the DEVELOPER"). WlTNE$SETH: WHEREAS, the DEVELOPER and Barbara Scottston are the fee owners of the following described property situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described as follows: Lot 1, Block 1; Lots 1, 2, and 3, Block 2; Outlots A, and C; Harmony Farm, Anoka County, Minnesota; the "Subject Property"; and WHEREAS, on October 22, 1996, pursuant to Resolution 96-10- , the CITY approved the finM plat of the Subject Property which plat is known as HARMONY FARM (the "Plat") contingen~t on certain requirements, including DEVELOPER and CITY entering into this contract; and WHEREAS, the final plat for the Subject Property conforms to the sketch plan for Harmony Farm approved by the Planning Commission on October 1, 1996, and WHEREAS, the DEVELOPER herein attests to the fact that there are wetlands existing on the Subject PrOperty; and WHEREAS, no expenditure of CITY funds, will be made until the City Code escrow requirements have been fulfilled by DEVELOPER; and WHERtgAS, City Code Section 9.50.50 defines "Stage I" Improvements and "Stage II" Improvements which definition is used herein when reference is made to "Stage I" and "Stage 11" Improvements; and WHEREAS, the DEVELOPER desires to provide for the Stage II improvements, except for those Stage II Improvements constructed by the CITY. 77
