NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />o <br /> <br />o <br /> <br />STAGE I IMPROVEMENTS AND FINANCIAL GUARANTEES. <br /> <br />.(~itv Code Com~>liance. That the DEVELOPER will develop the Plat <br />accordance with the City Code, Section 9.50, entitled "Subdivision" <br /> <br />Conformance with Plan. The Plat. shall be developed pursuant to the <br />plat consisting of one (1) sheet, prepared by Lot Surveys Company, Inc. <br /> <br />~[ncorr>oration of All City Code Requirements, That the recitals above and <br />the provisions of the City Charter, Subdivision Code, Zoning Code and PubLic <br />Improvement Code of the CITY as amended to date hereof, are incorporated herein <br />by reference. However, the CITY herein grants a variance to the 200 foot lot <br />width and 2.5 acre minimum area requirements on Lot 1, Block 1, to facilitate the <br />proposed future street identified as Ouflot A aligning with Coquina Street on the <br />south side of 167th Avenue. <br /> <br />Streets and Acc¢$.5. It is herein agreed that Lot 1, Block 1 and Lot 1, Block 2 <br />shall access 167th Avenue at the same location on Outlot A. In order to facilitate <br />this restriction, the CITY shall grant an easement for driveway purposes across <br />Outlot A to Lot 1, Block 1 and Lot 1, Block 2. It is further agreed herein that the <br />dwellings and any accessory sm~ctures developed on Lot i, Block 1 and Lot 1, <br />Block 2 shall be orientated towards Outlot A as if it were an improved public street <br />and the required front yard setback shall be applied to the common property line <br />with Outlot A. At such time as Outlot A is improved as a City street, the driveways <br />for Lot 1, Block 1 and Lot 1, Block 2 shall access this northerly extension of <br />Coquina Street rather than 167th Avenue N.W. <br /> <br />Resubdivi~ign. It is agreed that the Plat is subject to 4 in 40 density zoning and <br />Outlots B and C are not eIigible for resubdivision until such time as 4 in 40 density <br />zoning is repealed or municipal water and sanitary sewer are available to the <br />property. <br /> <br />Stage I Improvement~ Required. The Plat is a minor subdivision for which <br />no Stage I Improvements are required. <br /> <br />Area Restoral'ion. The DEVELOPER shall be responsible for restoration of all <br />areas disturbed by the development grading operation. The DEVELOPER shall <br />also be responsible for the cost of cleaning any soil, earth or debris from the <br />wetlands within and adjacent to this Plat resulting from grading performed in the <br />development of the land. <br /> <br />Rcmgy~ll 9f Debris, The DEVELOPER shall be responsible for the removal <br />and proper disposal of all debris, garbage, and fallen trees from the Subject <br />Property. <br /> <br /> II. <br />STAGE II IMPROVEMENTS <br /> <br />Street Cleaning. From time to time, the CITY may remove accumulations of <br />soil, earth and debris from the streets resulting from the construction of the Plat.
