WELLHEAD PROTECTION <br />IOINT POWERS AGREEMENT <br /> <br />THIS AGREEMENT is made and entered into by and between the cities of Andover, Anoka, Blaine, <br />Centerville, Circle Pines, Fridley, Lexington, Lino Lakes, Ramsey, St. Francis, and Spring Lake <br />Park (herein "Cities"), and the CountY of Anoka (herein "CoUnty), each acting by and thrOugli its <br />governing bod~, pursuant t0"Minn. Stat. §471.59 providing for the joint exercise of powers.- <br /> <br /> RECITALS: <br /> <br /> 1. The CitieS. are'now,, or will be; reqUired, lay the Minnesota Department. of Health tO prepare <br /> wellhead' ~rOtection plans for their communi.'.~Public water supplies-and desire to coordinate <br /> their effot~ts to develop wellhead protection plans for their: communities: <br /> <br />2. The Citi~ have determined that it is in their best interests to develop a common ground water <br /> model tha~ has common :elements for their wellhead protection plans including determination of <br /> wellhead protection areas around their public Water supply wells, and' desire to jointly use the <br /> services of a consultant for development of portions of their wellhead protection plans. <br /> <br />3. The Ciiies~. desire' to make a joint deCision COncerning the best method tS determine their needs <br /> and select~on of a groundwater model and agree that it is in their interests that the cost for <br /> developm~t of portions of their wellhead protection plans be shared and their respective <br /> responsib~ities and obligations be 'defined. <br /> <br />4. The County is committed to enhancing groundwater protection and Public health and funds it to <br /> be in the ~:ounty's interest to facilitate.the joint efforts of the Cities. - ':' "' <br /> <br />NOW THEREFORE, in consideration of the mutual agreements contained herein, and in exercise of <br />the powers granted by Minn. Stat. § 471.59, the parties to this Agreement agree as followsk "~ <br /> <br />1. PURPOSE <br /> <br />1.1 The Cities and County agree that they have joined together for the purpose of jointly and <br /> cooperatively: <br /> <br />1.1.1 <br />1.1.2 <br />1.1.3 <br /> <br />1.1.4 <br /> <br />TERM <br /> <br />d~_veloping common wellhead protection plans for the Cities; <br />establishing a joint user group to handle activities related to this agreement; <br />afithorizing the County to act as facilitator and as agent contracting for any consultant <br />services or applying for any grants; and <br />allocating costs. <br /> <br />This agreement shall be effective December 1, 1996 and shall continue until terminated as <br />provided he!ein. <br /> <br />3. ANOKA COUNTY MUNICIPAL WELLH]gAD PLANNING GROUP <br /> <br />3. i The governing body of each of the Cities shall appoint one person to serve as a member of the <br /> Anoka CountY Municipal Wellhead Planning Group (herein "Group"). <br /> <br />-I- <br /> <br /> <br />
