With the replat <br /> <br />November 22, 1996 <br /> <br />Robert Muller <br />22541 Tulip Street <br />St. Francis, Mn <br /> <br />Re: Final Plat Review; Muller Addition <br /> <br />D~ar Bob: <br /> <br />We have received your proposed final plat for a minor subdivision to be named Muller Addition. <br />The f'mal plat consists of one sheet prepared by Lot Surveys Company, Inc. <br />original application, we also received a site survey, also prepared by LOt Surveys Company, Inc. <br />dated November 8, 1996, that identifies the locations of all existing structures on the subject <br />property. We offer the following comments: <br /> <br />5z <br /> <br />~ The subject plat is a replat of Lots 2 and 3 of Block 7, Klemish Addition, and <br />two unplatted lots subsequently created from the easterly portion of Lot 3. Currently; the <br />Super Valu structure and the former bank structure occupy the 3 southerly lots and a <br />residential homestead occupies the northernmost lot. The purpose of the replat is to achieve <br />one lot for each of the commercial structures with conforming setbacks. <br /> <br />o <br /> <br />Business. <br />identifying the specific amount of area needed by both the grocery store and the bank, the <br />applicant should consider rezoning that part of LOt 1 not used for commercial purposes <br />back to R~ 1 Rural Residential. <br /> <br />Lot Sizes: The two commercial lots (Lots 2 and 3) exceed the 1 acre m4nimum lot size <br />requirement and the residential lot to the north (Lot 1) maintains compliance with the 2.5 <br />acre minimum lot size for rural residential lots in this area. <br /> <br />Lot Dimensigns: All 3 of the lots comply with the 200 foot lot width or road frontage <br />requirement. <br /> <br />Structt!re Setbacks: As the new property lines are proposed to be drawn, the Super <br />Valu structure will exceed the 35 foot front, 10 foot side and 35 foot rear yard setbacks for <br />the B-1 Business District. <br /> <br />I <br /> <br />The bank structure, for which the drive-up canopy currendy extends into the 39 foot public <br />fight-of-way located adjacent to the 60 foot T.H. #47 fight-of-way, will also meet all <br />structure setback requirements for the B-1 Business District if the 39 foot easement is <br />vacated as proposed. In looking back through City records, it appears that a condition of <br />the Klemish Addition plat was that in addition to the 60 foot fight-of-way required for T.H. <br />#47, the City required an additional 39 foot wide easement in the event a service road was <br />needed parallel to T.H. ¢47 at some point in the future. It is not likely that such a service <br />road will ever be constructed and Mr. Muller has requested vacating the 39 foot easement <br />so that the bank structure will not encroach into any public easement. The processing of <br />that vacation of easement request has been initiated, but the City has also identified the need <br /> <br />I <br />I <br />I <br />I <br /> <br /> <br />
