Case ~e7: Update on Landmark Bank Development Agreement City Administrator Schroeder stated that at the last City Council meeting, we had a discussion about the Landmark Bank development agreement. He disseminated a letter (See Exhibit "A") from Kevin Johnson, Johnson Hold/ngs, Inc. Mr. Johnson has experienced some delays and the letter outlines that. He's asking that Johnson Holdings, Inc. be allowed the opportunity to extend the development period with a tentative date of August 1, 1997. The rationale is that he would otherwise be in the winter construction period and would choose not to be involved in that kind of construction. Motion by Councilmember Peterson and seconded by Councilmember Beahen to amend the completion date in the Development Agreement to August 1, 1997, for Landmark Community Bank. Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson and Beahen. Voting No: Councilmember Zimmerman. Absent: Councilmember Beyer. Mr. Schroeder noted that the next case on the agenda is a request from Mr. Johnson for an Interim Use Permit. Mr. Johnson will be withdrawing that request. Case #8: Request for an Interim Use Permit for a Temporary Structure; Case of Johnson Holdings, Inc. Motion by Councilmember Beahen and seconded by Councilmember Peterson to accept the applicant's request to withdraw the request for an interim use permit for a temporary structure. Motion carded. Voting Yes: Mayor Hardin, Councilmembers Beahen, Peterson and Zimmerman. Voting No: None. Absent: Councilmember Beyer. Case ~9: Award Contract for Improvement Project #96-23 McKinley Street to Commercial Asphalt Property This case was removed from the agenda. Case #10: Cable Franchise Transfer Agreement City Administrator Schroeder reported that the current cable operator, Meredith Cable, is proposing to transfer ownership to Continental Cable, who in turn will transfer their ownership to US West. It is expected that US West Will ~ansfer their ownership to a third entity within two years. Motion by Councilmember Peterson and seconded by Councilmember Beahen to adopt Resolution ~P96-09-256 consenting to the transfer of control of and certain ownership interests in a cable television franchisee to Continental. Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beahen and Zimmerman. Voting No: None. Absent: Councilmember Beyer. Motion by Councilmember Peterson and seconded by Councilmember Beahen to adopt Resolution ~'96-09-257 consenting to the transfer of control of and certain ownership interests in a cable television franchisee to US West.
