Councilmember Beyer introduced the following resolution and moved for its adoption: RESOLUTION #96-05-132 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT FOR A FOSTER GROUP HOME AND DECLARING TERMS OF SAME. foster 154th WHEREAS, Patrick J. McLafferty has properly applied for a conditional use permit for a group home in the singe family dwelling unit on the property generally known as 7321 Lane N.W. and legally described as follows: The South 240 feet of the North 480 feet of the West 225 feet of the East 850 feet of the Southeast Quarter of the Northeast Quarter of Section 21, Township 32, Range 25 in Anoka County, Minnesota; said distances being measured parallel with the East and North lines of said Southeast Quarter of the Northeast Quarter, subject to an easement for road purposes over the South 33 feet thereof, Anoka County, Minnesota (Subject Property); and WHEREAS, the Planning Commission met on May 7, 1996, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact it0401, a conditional use permit for a group foster home is hereby granted to Patrick J. McLafferty, hereinafter referred to as "Permittee". Should the Permittee die or move to a new location, the permit shall be automatically terminated; except that in the case of death, should a surviving spouse residing at the same address desire to continue the foster home, written notice to that effect shall be given to the City Administrator, and the City Council may authorize continuation of the permit without further hearing. The facility shall serve no more than eight (8) foster children. The Permittee shall maintain current State and County licenses at all times; any lapse of required licensing shall automatically terminate this Permit. The Permittee shall be responsible for providing the City with copies of inspection and/or licensing reports generated by agencies with jurisdiction over the group home. The Permittee shall be responsible for maintaining the dwelling unit in compliance with all applicable Fire and Building Codes. The Permittee shall not make alterations to the exterior of the house or property that are not residential 'in character. Extraordinary incidences of police and/or zoning complaints shall serve as just cause for the City Council to consider revocation of this Permit in accordance with procedures established in Section 9.03.04 (Conditional Use Permits) of the City Code. The primary purpose of the facility shall not be for the treatment of juvenile sex offenders in accordance with State statutes. I I I I I I I I I
