~1/20/9S i0:26 LAW OFFICES 2148 4TH RUE ~ 612 42? 5543 N0.008 P02 <br /> <br />ORDINANCE #96-XX <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AN AME~rDMENT TO CHAPTER 7 OF T~E CITY CODE WHICH IS KNOWN AS THE <br />LICRn~SING AND PERMITS CHAPTER OF THE CITY CODE OF THE CITY OF <br />RAMSKY, MINNESOTA <br /> <br />AN ORDINANCE AMENDING CHAPTER 7 OF THE CITY CODE BY THE ADDITION <br />OF SECTION 7.93 ENTITLED "ELECTRIC AND GAS FRANCHISE FEES" <br /> <br />SECTION 1. AMENDMENT - The following Section 7.93 is hereby added <br />to the City Code: <br /> <br /> 7.93 - ELECTRIC AND GAS FRANCHISE FEES <br /> <br /> Subd. 1 - DEFINITIONS. The following words and terms wherever <br /> they occur in this Section shall be construed as below <br /> defined: ~ <br /> <br />"Companies" or "each company" means Anoka Electric <br />Cooperative, a Minnesota cooperative, its successors and <br />assigns, Midwest Gas, an Iowa corporation,~its successors <br />and assigns, Anoka Electric, a munidipal electric <br />distributor, its successors and assigns,' and any other <br />entity selling energy to customers in the City for any <br />use related to heating, cooling, lighting and running <br />machinery and appliances, provided that the City has the <br />authority to require a franchise fee or impose a tax on <br />each of the foregoing. ~ <br /> <br />"Gross revenues" means all sums received by each <br />company's sale of energy to its customers within the <br />corporate limits of the City, excluding any surcharge or <br />similar addition to each company's charges to customers <br />for the purpose of reimbursing for each company the cost <br />resulting from the franchise fee, and also excluding <br />sales of energy to customers solely for use as a fuel for <br />vehicles. ~ <br /> <br />"Commercial and industrial customer" meank a customer so <br />classified by each company except as defined below. <br /> <br />"Institutional Customer" means a user ~of energy for <br />purposes other than residential uses as defined below or <br />other than retail or wholesale trade or manufacturing or <br />warehousing, including but not limited to churches, <br />schools and government facilities. <br /> <br />ORDINANCE #96- <br /> Page 1 of 4 <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
