Sub~. 2 - FRANCHISE FEE a. Amount. The City hereby imposes a franchise fee equal ~ to the applicable percentage, hereinafter~ set forth, of the gross earnings of each company. Such!fee shall not exceed any amount which each company may legally charge to its customers, prior to payment to :the City, by imposing a surcharge equivalent to such fee in it rates for energy service. Each company may pay the City the fee based upon the surcharge billed subject to subsequent reductions to account for uncollectibles or customers' refunds. Each company may add to its effective rate schedules a surcharge equal to the applicable franchise fee to reimburse each company for the' cost of the franchise fee, but such surcharge shall~be separately stated on energy bills to customers within'the City. The time and manner of collecting the franchise fee is subject to the mutual agreement of the City Council and the Utility's Board of Directors on Commission, which agreement each company agrees to use its best efforts to ~ obtain. The initial franchise fee imposed by this section shall be in the amount of the percentage set forth below on that portion of gross r~venues derived ~ from sales to each company's customersI based on the ~billing months for the applicable calendar quarter. ~Commercial and Industrial Customers - three tenths of one percent (.3%) Residential Customers - One percent (1%)I Institutional Customers - One percent (1%) The franchise fee may be changed from time to time by ~resolution of the City Council but not more. of-Ten than ~annually. Ail changes in the franchise fee must comply .with the notice provisions of subd. 4 hereof. -Term. The franchise fee shall be paid to the City during 'the term of the franchise granted to each company, and in lieu of any permit or other fees relating to the repair, maintenance and/or operation of. the company's ~acilities currently .being imposed on :the respective companies by the City.
