Board Member <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION //96-03- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO <br />A REQUEST FOR A VARIANCE TO MINIMUM LOT~ZE FOR NON- <br />RIPARIAN LOTS ON A RECREATIONAL DEVELOPMENT LAKE <br /> <br /> WttEREAS, Good Value Homes, Inc., hereinafter referred to as "Applicant", has <br />properly ai~plied for a Board of Adjustment variance from Section 9.21.04 of the Ramgey <br />City Codelto plat non-riparian lots on Grass (Sunfish) Lake (Protected Water #2-113) at <br />less than the required 15,000 square feet. <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE <br />OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing <br />pursuant to Section 9.03.05 of the Ramsey City Code on March 4, 1996, and that <br />sai~d public hearing was properly advertised and that the minutes of said public <br />he,~Sng are hereby incorporated as a part of these findings by reference. <br /> <br />That the Applicant has submitted a request for subdivision to the City of Ramsey <br />for!a plat proposed to be named Sunfish Lake Estates on the property legally <br />described as follows: <br /> <br />(INSERT LEGAL H~ERE) <br /> <br />That the proposed plat lies within the shoreland overlay district for Grass (Sunfish) <br />Lake (Protected Water #2-113). <br /> <br />That Section 9.21.04 of the Ramsey City Code establishes a minimum lot size of <br />20,000 square feet for riparian lots and 15,000 square feet for non-riparian within <br />the tsewered area of the subject overlay district. <br /> <br />That the Applicant's plat proposes to create 25 single family urban residential lots <br />within the 12 acre area, ten (10) of which are considered riparian and fifteen (15) of <br />which are considered non-riparian. <br /> <br />Tha. t the Applicant has stated that the minimum lot sizes in the overlay district create <br />a h~dship because of the marginal depth of developable property between the lake <br />and. Sunwood Drive, and the need for the lots within the plat to be served by a <br />minor street off of Sunwood Drive. <br /> <br />That the Applicant has stated that the marginal depth of developable property <br />betWeen the lake and Sunwood Drive is due, in part, to the fact that the alignment <br />for Sunwood Drive has been relocated nearer the lake than origianlly proposed or <br />planned. <br /> <br />That the Applicant has designed the plat in such a manner that the ten (10) riparian <br />lots meet the 20,000 square foot area requirement. <br /> <br /> <br />
