1I. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />That the Applicant's plat proposal is designed in such a manner that only four (4) of <br />the fifteen (15) non-riparian lots meet the 15,000 square foot area requirement. <br /> <br />That the plat proposes an average lot size of 13,822 square feet for non-riparian lots <br />and 21,756 square feet for riparian lots, for a total of 424,890 square feet absorbed <br />by 25 lots. Under Section 9.21.04 of the Ramsey City Code, 25 lots meeting the <br />15,000 and 20,000 square foot area requirements would absorb 425,000 square <br />feet of property. Therefore, the Applicant's proposal does not increase the number <br />of lots that would have been a/lowed had the area requirements been complied with <br />on a lot by lot basis. <br /> <br />That the intent of the development' standards in the overlay district are to preserve <br />and protect public waters from pollution. <br /> <br />That the subject plat will be served by a municipal water system and the existing on- <br />site septic system for the riparian homestead will be convened to the municipaI <br />system. <br /> <br />That the subject plat will be served by a storm sewer system. <br /> <br />That the special conditions causing the hardship, namely the depth of the subject <br />property lying between the lake and the collector street, do not result from the <br />actions of the Applicant. <br /> <br />That if granted, the variance wi/l/will not grant the Applicant any special privilege <br />that is denied to other owners of lands in the same district. <br /> <br />I6.
