Board Member <br />adoption: ~ <br /> <br />inn'oduced the following resolution and moved for its <br /> <br />RESOLUTION #96-06- , A RESOLUTION ADOPTING FINDINGS OF <br />FACT # ~ RELATIN-G~-TO A REQUEST FOR A VARIANCE TO THE <br />IMPERVID'"0-S SURFACE AREA REQUIREMENTS IN THE MISSISSIPPI <br />CRITICAL RIVER CORRIDOR <br /> <br /> WHEREAS, L.A.N.D..Properties, Inc., hereinafter referred to as "Applicant", <br />has properly applied for a Board of Adjustment variance from Section 9.21.07 (Critical <br />River Overlay[District Development Standards) of the Ramsey City Code to develop a <br />parcel with a 7,7% impervious surface area on the property legally described as follows: <br /> <br />Lot 1, Block 1, RIVERSDE WEST, Anoka County, Minnesota. <br /> <br /> (the "Subject Property") <br /> <br /> NOW i THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE <br />OF MINNE~;OTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing <br />pursuit to Section 9.03.05 of the Ramsey City Code on June 4, 1996 and that said <br />public hearing was properly advertised and that the minutes of said public hearing <br />are hereby incorporated as a part of these findings by reference. <br /> <br />o <br /> <br />That the subject property is zoned B-3 Highway Business and is approximately 5 <br />acres in size. <br /> <br />That the Subject Property is located in the Mississippi Critical River Overlay <br />District. <br /> <br />That the property to the north, west and east is zoned B-3 Highway Business, and <br />the property to the south is zoned R-1 Urban Residential. <br /> <br />5. That the Applicant is proposing to develop a retail center on the subject property <br /> <br />That Section 9.21.07 (Critical River Overlay District Development Standards) of the <br />Ramses, City Code restricts the impervious surface area to 30% of the lot in order to <br />mainta, j.n the water quality and prevent pollution of the Mississippi River and <br />preserVe the natural aesthetic value of the corridor. <br /> <br />That the Subject Property is not visible from the Mississippi River and the <br />Applicant has proposed a drainage plan that appears to meet the minimum water <br />quality-requirements of the Lower Rum River Water Management Organization. <br /> <br />That similar variances have been granted to properties in the Mississippi Critical <br />River Overlay District that were certified by DNR. <br /> <br />That the Applicants request for a variance to the impervious surface area has been <br />forwarded to the Department of Natural Resources. <br /> <br /> <br />
