Namely: a) the subject property <br />is in the Critical Overlay District and lot development is restricted to 30% of the lot <br />area; b) Other parcels in the Overlay District were allowed to be developed beyond <br />the 30% impervious surface area limit through variances granted; c) City Code <br />requires that all off-street parking, driveways and maneuvering areas be paved and <br />curbed in the Business district. <br /> <br />That the proposed coverage of the lot by buildings is approximately 17%, which is <br />in accordance with the 35% lot coverage restrictions for the B-3 Highway Business <br />District. <br /> <br />That the Subject Property cannot be put to a reasonable use under the 30% <br />impervious surface area restriction considering its present commercial zoning and <br />valuation. <br /> <br />That the special conditions causing the undue hardship, inclusion of the property in <br />the Critical River Overlay District, do not result from the actions of the Applicant. <br /> <br />That such variance is/is not necessary for the preservation of a substantial property <br />right similar to that possessed by other properties in the B-3 Highway Business <br />District. <br /> <br />That if granted, the variance will/will not grant the Applicant any special privilege <br />that is denied to other owners of lands, structures or buildings in the same district. <br /> <br />That if granted, the variance Mil/will not be materially detrimental to the purposes <br />of the Ramsey Zoning Chapter or other property in the B-3 Highway Business <br />District. <br /> <br />That if granted, the variance will/will not substantially increase the congestion of <br />public streets, or increase the danger of fire, or endanger the public safety, or <br />substantially impair property values within the neighborhood. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board <br />Member and upon vote being taken thereon, the following voted in <br />favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment <br />this the day of ,1996. <br /> <br /> <br />
