Member <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #96-06- , <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND <br />DECLARING~ TERMS OF SAME <br /> <br /> WHEI~EAS, L.A.N.D. Properties has properly applied for a variance from the <br />impervious surt~ace area restrictions in the Critical River Overlay District on the property <br />legally describedd as follows: <br /> <br />Lot 1, Block 1, RIVERVIEW ESTATES, Anoka County, State of Minnesota <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, the Board of Adjustment met on June 4, 1996, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from impervious <br />surface area resfi-ictions. <br /> <br /> NOW rTHEREFORE, BE IT RESOLVED BY THE BOARD OF <br />ADJUSTMEI~T OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE <br />OF MINNESOTA, as follows <br /> <br />Based .On Findings of Fact # <br />restricuon is hereby granted. <br /> <br />· a variance to the impervious surface area <br /> <br />The ret.gil center shall be allowed for development on the Subject Property with an <br />impervmus surface area limit not to exceed 77% of the lot area. Impervious <br />surfaces shall include all structures and surfaced driveways and parking areas. <br /> <br />The property owner shall manage all storm water runoff on and for the Subject <br />Property, in accordance with the specifications and standards of the Department of <br />Natural ',Resources and the Lower Rum River Water Management Organization. <br /> <br />The property owner shall obtain all necessary permits prior to commencing any <br />construction. No building permit for the structures shall be released by the City of <br />Ramsey~ without certification of the variance by the Department of Natural <br />Resources in accordance with procedures established Section 9.21.07 (Critical <br />River OVerlay District Development Standards) of the Ramsey City Code. <br /> <br />The property owner shall be responsible for all City costs incurred in administering <br />and enforcing this variance. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board <br />Member and upon vote being taken thereon, the following voted in favor <br />thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br /> <br />
