REVIEW FINDINGS <br />PUBLIC IMPROVEMENT <br /> By: Ryan R. Schroeder, <br /> <br />OF FACT FOR <br />PETITION PROCESS <br /> City Administrator <br /> <br />CASE <br /> <br />Backgroun~d: <br /> <br />On October 24, 1995, the Ramsey City Council directed the Charter Commission to review <br />whether or n!ot Chapter 8 of the City Charter should be amended to prohibit Council from <br />ordering a p~blic improvement project unless more than 50% of the benefitting property <br />owners are ~n favor of it. This direction to the Charter Commission resulted from the <br />petitioning ~rocess for public improvements in Haubrich Addition. <br /> <br />Observati$ns: <br /> <br />The Charter Commission met on November 30, 1995, and reviewed the current <br />requirement~ of the City Charter. After some discussion, it was determined that 50/50 is <br />the most eq$itable, that there haven't been that many problems with the current process to <br />date, that it !s appropriate for Council to be the decision maker in fie situations, and it is not <br />necessary tO be more rigorous than State Statutes than we already are. <br /> <br />Recomme,ndation: <br />Staff recor~wnends adoption of the enclosed finding of facts as a formal response to <br />Council's ifiquiry for information. <br /> <br />Commissibn Action: <br /> <br />Motion to ~ opt Resolution g'96-01- <br /> · ~. . . adopting Findings of Fact # <br />C~ty Counqxl mquu'y regarding Chapter 8 of the Ramsey City Charter. <br /> <br />~ to respond to <br /> <br />Reviewed by: <br /> <br />City Administrator <br /> <br />Charter: 01/18/96 <br />/jmt <br /> <br /> <br />
