Charter Commi~sioner and moved for its adoption::~ inu'oduced the follqwing resolution RESOLUTION RESOLUTION ADOPTING FINDINGS OF FACT # TO RESPOND TO CITY COUNCIL INQUIRY REGARDING CHAPTER i~'~F THE RAMSEY CITY CHARTER wHER[EA$, on October 24, 1995, the Ramsey City Council directed the Charter Commission tolreview whether it is warranted to amend Chapter 8 of the City Charter to restrict City Council frc[m ordering a local improvement project unless the favorable petition received was signed by morelthan 50% of the benefitting property owners. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSE¥, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That th~ Charter Commission met on November 30, 1995, and reviewed the current requirethents of City Charter Chapter 8. That thr* Charter Commission determined that 50/50 is the most equitable equation that can be achisved. ge That the Charter Commission reflected that the City Council is charged with making decisions in the best interest of the City. That thi: Charter Commission determined that it is appropriately within the Council's maim to be ~e decision maker or tie breaker when there is a 50/50 petition for a public improx/ement project. That ~e Charter Commission determined that the current process for ordering public improvement projects is more rigorous than State Statute and to make it more so could create problems and rais~ barriers. Ge That the Charter Commission determined that there had not been a sufficient number of report~ of problems with the current process to warrant amending Chapter 8. That me Charter Commission determined that the current 50/50 process most nearly emulates democracy in action. The motion for the adoption of the foregoing resolution was duly seconded by Charter.
