Frolik:

This letter is a follow-up to the review letter that I sent yesterdsy, December 28. Item No. 2 of that letter states
that the conditions of'the City's shorelimd ordinan~ are met by both the Pondviow Preliminal'y Plat and the
Sunfish ]Estates Sketch Plan. After it was brought to my attention and after giving it further reviver, both
proposals have problems with the lot sizes.

I'OArDVI~W PRELIMINARY PLAT
Public waters wetland 2-11SP has a shore]and classification of C,-eners} Development, with a minimum lot size of
15,000 square feet for riparian Jots and ] 0,000 square feet for non-riparian in sewered area$. Minnesota Rules
Part 6120.3300, Subpart 2, Item A. states in part, ".,.Only land above the ordinary kigh water level (OHW) of
public waters can be used to moot Jot arem standards...". Eighteen o£the riparian lots do not meet thc required
15,000 square feet above the OHW.

Lot widths at the OHW and at the building line all appear to be acceptable.

SUNFISH ESTATES SKETCH PLAN
Sunfish Lake (public waters basin No. 2-I I3P) is classified a Recreational Development I~ke and requires a
20,000 square feet and 15,000 square feet lot size for riparian and non-riparian lots, respectively, in sewored
areas. Again Minnesota Pules require that the minimum lot size be calculated above the OHW. Only :2 or 3 of
the non-riparian lots meet the 15,000 square foot lot size and it is difficult to tell at this ~ if any of the riparian
lots have sufficient are~ above the OHW.

I apologize for missing these obvious problems In my first l~ter. I hope that it has not caused too much
confusion. Thank you for this additional opportunity to comment.
