CASE <br /> <br />CONSIDER PROPOSED ORDINANCES TO AMEND CHAPTER 9 (ZONING <br />AND SUBDIVISION OF LAND) OF THE RAMSEY CITY CODE, SECTION 9.21 <br /> (ENVIRO .NIMENTAL PROTECTION) AND SECTION 9.23 (SCENIC RIVER) <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On July 3, 198~, the revised Statewide Standards for "Management of Shoreland Areas" rules <br />became effective,. Under the authority of those new rules, the City of Ramsey must update its <br />ordinance acco .'r~ingly. <br /> <br />Observations: <br /> <br />On January 2, 1D96, the Planning Commission reviewed the recommended ordinance amendments <br />and directed St~ff to make some changes to the draft per their discussion. The Commission has <br />drafted an ordinance in accordance with revised State standards, except for the following areas: <br /> <br /> a) Section 9.21.04, Sulxl. 5.1: Structure height limitations in residential districts - <br /> ~, tate standards recommend 25 feet; Ram.~ey is proposing 35 feet. <br /> <br /> b) ~ection 9.21.05, Subd. 2.e.5: Ramsey is not proposing to adopt recommended <br /> ~, tate standard that requires ail structures in the Critical River Area Overlay District <br /> t~be screened so as to be visually inconspicuous or difficult to see as viewed from ' <br /> e river during the summer months. <br /> <br /> c) Section 9.21.07, Ssubd. 1.b: River setback any permiited use - Ramsey is <br /> l~roposing to eliminate the clause: "whichever is greater". <br /> <br />The draft was f6rwarded to DNR for review and at the date of this writing, no response from DNR <br />has been receiv ,dd. <br /> <br />Recommenda!ion: <br />City Staff recortimends forwarding the ordinance to City Council for adoption. <br /> <br />CommiSsion Action: <br /> <br />Motion <br />Recommend that City Council adopting the proposed ordinance to amend the <br />Enviromtnental Protection and Scenic River sections of the Ramsey City Code. <br /> <br />Review Checldi St: <br />PC: <br /> <br />DNR <br /> <br />2/6/96 <br /> <br /> <br />
