Scenic River § 9.23 <br /> Subd. 3. Any public or private supply of water for domestic purposes must <br />conform to Minnesota Department of Health Standards for water quality ~md the administrative <br />procedures of other applicable local ordinances. <br /> <br />9.23.08 <br /> <br />Placement of structures. <br />I. Structures proposed within a flood plain area shall be consistent with all flood <br /> plain management regulations of the City. <br /> <br />2. No structure shall be placed on any slope greater than 12% (12 feet vertical <br /> rise in 100 feet horizontal distance) unless such structures can be screened. <br /> sewage disposal facilities can be installed so as to comply with the sanitary <br /> provisions of §9.23.07 of this Section, and the permit applicant can prove to <br /> the Zoning Authority that any potential erosion or sedimentation problems <br /> related to locating such a structure either do not exist, or that adequate <br /> measures will be taken to prevent such problems through special construction <br /> methods. <br /> <br />9.23.09 Subdivision of land. <br /> <br /> Subdivision 1. No land shall be subdivided which is determined by the City, or <br />the Commissioner of Natural Resources, to be unsuitable by reason of flooding, inadequate <br />drainage, soft and rock formations with severe limitations for development, severe erosion <br />potential, unfavorable topography, inadequate water supply or sewage treatment capabilities or any <br />other feature likely to be harmful to the health, safety, or welfare of the future residents of the <br />proposed subdivision or the community. Soil percolation rate tests and soil borings shall be <br />required on each proposed subdivision within the Rum Scenic River Land Use District, to establish <br />the suitability of the land for development. Such testing is required before any final plat may be <br />approved, but may be waived by the Zoning Administrator when adequate data is already available. <br /> <br /> Subd. 2. Planned Unit or Cluster Developments may be allowed in the Scenic <br />River Land Use District ff preliminary plans are first approved by the Commissioner of Natural <br />Resources and the applicable provisions of MN Rules, parts 6105.0010 - 6105.0250, 6120.2500 - <br />6120.3900, pertaining to such development in the Urban Area and in the Rural Area are satisfied, <br />and the City Code is satisfied. <br /> <br />9.23.10 <br /> <br />Landscape alterations. <br /> <br />Subdivision 1. Vegetative Cutting. <br /> <br /> a. The vegetative cutting provisions of §9.23.10 shall apply to those areas <br /> as specified in {}9.23.06 of this chapter. <br /> <br /> b. General prox4sions within designated setback areas: <br /> 1. Clear cutting, except for any authorized public services such as <br /> roads and utilities, shall not be permitted. <br /> 2. Selective cutting of trees in excess of four inches in diameter at <br /> breast heights shall be permitted providing cutting is spaced in <br /> several cutting operations and a continuous cover is maintained. <br /> 3. The cutting provisions of paragraphs 1 and 2 above shall not be <br /> deemed to prevent: <br /> (a) The removal of diseased or insect infested trees, or of rotten <br /> or damaged trees that present safety hazards. <br /> (b) Pruning understory vegetation, shrubs, plants, brushes, <br /> grasses, or from harvesting crops, or cutting suppressed <br /> trees or trees less than four inches in diameter at breast <br /> height. <br /> <br /> <br />
