Councilmcmber introduced the following resolution and moved for its adoption: RESOLUTION 96-03- RESOLUTION DECLARING CONDITIONS OF AMENDED CONDITIONAL USE PERMIT FOR AN ALUMINUM PROCESSING PLANT WHER~J~AS, the Rarmey City Council issued a condilaonal use perrmt to Alloy Recovery Company on A~ril 23, 1991, to establish and operate an al. minum processing plant in the Business Warehouse Dis~ct on the property generally known as 7060 142nd Avenue N.W. and legally described as Lo[ 2, Block 1, Gateway North Industrial Park Plat 1; and WHER gAS, on February 7, 1996, the City of Ramsey received an application from Alloy Recovery Cornt any to expand the principal structure for the aluminum processing facility by 9,000 square feet; and~ WHERIgAS, the Ramsey City Council adopted Resolution g96-03- , adopting Findings of Fact # f :~r the enlargement of an aluminum processing facility use and herein approves the issuance of an a~ ended Conditional Use Permit for the facility subject to the following conditions. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY~ ANOKA COUNTY, STATE OF MINNESOTA, as follows: This permit is isaued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of this permit are as follows: Term. This permit shall remain in effect so long as the conditions imposed herein are comPlied with. Noise. Noises emanating from the site and operations shall be in compliance with and regulate~ by the State of Minnesota Pollution Control Standards, Minnesota Rules 7010.0010 to 7010..0080, as amended except as modified herein by City performance requirements. o Dust/Ash~Particulate$. The emission of dust, ash or other particulates matter shall be in complian~ with and regulated by the State of Minnesota Pollution Control Standards, Minneso~ Rules 7005.0010 - 7005.0080, 7005.2770 subp. 2.A., and 40 CFR Part 50 as amendedtexcept as modified herein by City performance requirements. Odor. Tt~e emission of odor from the operation shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as amended except as Imodified herein by City performance requirements. Smoke. The emission of smoke from the operation shall be in compliance with and regulated by the State of Minnesota Pollution Control standards, Minnesota Regulation 7005.0480 subp. 1.BI, as amended except as modified herein by City performance requirements. Furnace l~mission~ and Monitoring. Emissions from the melt furnace shall comply with State and Federal regulations as they exist and may be modified from time to time during the period of this CUP. An independent testing laboratory shall conduct emissions monitoring at least once per Fear and on a more frequent basis if pollutants are in excess of standards. The Permit HaJder shall make a complete report available to the City within thirty (30) days of completio~a by the testing laboratory. At a minimum, the parameters of such emissions monitoring shall include the following State and Federal criteria pollutant emissions as may
