CASE # ~' <br /> REQUESTi FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORT <br /> ~ SOILS; CASE OF GOOD VALUE HOMES, INC. <br /> By: City!Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik <br /> <br />Background:~ <br />On January 4, 1~996, the City received an application from Good Value Homes, Inc. to grade and <br />export soils frclm that area proposed to be platted as Pondview. Pondview consists of 85 acres <br />proposed to be ~ubdivided into 130 single family lots. <br /> <br />The following iiems are enclosed for your information: <br /> <br /> a) Site location map <br /> b) Grading Plan <br /> c) ,.proposed findings of fact <br /> d) yroposed conditional use permit <br /> <br />Notification: <br /> <br />Conditional UsgPermits are required to be subjected to public hearings with ail properties within <br />350 feet being ~hotified of the public hearing. In this case, Staff attempted to notify all property <br />owners within ,gOO feet of the subject property. The Anoka County Highway Department was <br />notified of the aonditional use permit application along with the proposed plat of Pondview. The <br />County has mac~e no response specific to the conditional use permit but has provided input as to the <br />appropriate loc~tions for accesses onto County Road #116. <br /> <br />Observationsi <br /> <br />The grading pla~ submitted for approval with the Pondview preliminary plat will require exporting <br />approximately ~20,000 yards of material from the site. City Code does not require a special permit <br />for grading opelrations associated with an approved plat, unless the operations involve exporting <br />soils from the s!te. There are three haul road access points proposed: two on County Road #116 <br />and one on 149fia Avenue. <br /> <br />The Applicant has indicated that the grading operation could take 12 months to complete. <br /> <br />Silt fence and o~er erosion control measures have been proposed to protect adjacent properties and <br />the wetland. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the permit contingent upon elimination of 149th Avenue as a <br />haul road. ~ <br /> <br /> CommiSsion Action: <br /> <br /> Motion tO: <br /> Recornn~end that City Council adopt Findings of Fact relating to Good Value's request for <br /> a conditional use permit to grade and export soils. <br /> <br /> -and- <br /> <br /> Motion tO: <br /> Reconm~nd that City Council approve/deny Good Valde's request for a conditional use <br /> t~grade <br /> permit and export soils in the proposed plat of Pondview. <br /> <br />PC:Review Chec sit: ~ 4/2/96 City Engineer <br /> <br /> <br />
