Councilmei nber introduced the following resolution and moved for its adoption: RESOLUTION #96-05- A RESOLUTION ADOPTING FINDINGS REQUEST FOR A CONDITIONAL USE HOME. OF FACT # RELATING TO A PERMIT FO'-~'-'-A GROUP FOSTER pubfic WHEREAS, on February 7, 1995, Patrick J. McLafferty, hereinafter referred to as "Applicant", applied for a Conditional Use Permit for a Group Foster Home on the property generally knowfi as 7321 154th Lane N.W. and legally described as follows: The SoU~ 240 feet of the North 480 feet of the West 225 feet of the East 850 feet of the SoutheaSt Quarter of the Northeast Quarter of Section 21, Township 32, Range 25 in Anoka 12ounty, Minnesota; said distances being measured parallel with the East and North lines of Said Southeast Quarter of the Northeast Quarter; subject to an easement for road purposea over the South 33 feet thereof. WHEREAS, on April 25, 1995, the Ramsey City Council adopted Resolution g95-04- 076 declaring Fihdings of Fact//0375 and denied the application for a conditional use permit; and WHEREAS, the Applicant filed an appeal with the courts; and WHEREAS, the Anoka County District Court has ordered the City to conduct a second hearing arid reconsider the request for a conditional use permit. NOW I~HEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That on March 15, 1996, the District Court, Anoka County, Minnesota, issued an order directing!the City to reconsider the Applicant's application for a conditional use permit and, in arrivi/3g at a decision to grant or deny such application, shall make appropriate and detailed~ndings regarding the basis for its decision as prescribed by Ramsey Zoning OrdinanCe, Section 9.03.04. That the iApplicant appeared before the Planning and Zoning CommiSsion for a second public hoaxing pursuant to Section 9.03.04 (Conditional Use Permits) of the Ramsey City Code on [May 7, 1996 and that said public hearing was properly advertised and that the minutes Of said public hearing are hereby incorporated as a part of these findings by reference. 3. That the Subject property is approximately one acre in size. o That the ~subject property is zoned R-1 Rural Residential and is not served by sanitary sewer and municipal water. That the ~ity utilizes State Statute 462.357 (Subd. 7 and 8) as a guideline and allows state licensed ~esidential facilities accommodating up to six (6) youth in the single family residential, districts as a permitted use and facilities accommodating more than six (6) youth are recorrimended for operation in higher density housing districts. 6.
