We are also in <br />receipt of a site survey, also prepared by Lot Surveys Company, Inc. dated November 8, 1996, <br />that identifies the locations of alt existing structures on the subject property. We offer the <br />following comments: <br /> <br />General: The subject plat is a replat of Lots 2 and 3 of Block 7, Klemish Addition, and <br />two unplatted lots subsequently created from the easterly portion of Lot 3. Currently, the <br />Super Value structure and the former bank structure occupy the 3 southerly lots and a <br />residential homestead occupies the northernmost lot. The purpose of the replat is to achieve <br />one lot for each of the commercial structures with conforming setbacks. <br /> <br />Zoning: Proposed Lots 2 and 3 and the southerly 150 feet of Lot 1 are zoned B-1 <br />Business. The remainder of Lot 1 is zoned R-1 Rural Residential. With the replat <br />identifying the specific amount of area needed by both the grocery store and the bank, the <br />applicant should consider rezoning the that part of Lot 1 not used for commercial purposes <br />back to R-I Rural Residential. <br /> <br />Lot Sizes: The two commercial lots (Lots 2 and 3) exceed the 1 acre minimum lot size <br />requirement and the residential lot to the north (Lot 1) maintains compliance with the 2.5 <br />acre m/nimum lot size for rural residential lots in this area. <br /> <br />Lot Dimensions: All 3 of the lots comply with the 200 foot lot width or road frontage <br />requirement. <br /> <br />Structure Setbacks; As the new property lines are proposed to be drawn, the Super <br />Valu structure will exceed the 35 foot front, 10 foot side and 35 foot rear yard setbacks for <br />the B-1 Business District. <br /> <br />The bank sumcture, for which the drive-up canopy currently extends into the 39 foot public <br />easement located adjacent to the 60 foot T.H. #47 right-of-way, will also meet all structure <br />setback requirements for the B-1 Business District if the 39 foot easement is vacated as <br />proposed. In looking back through City records, it appears that a condition of the Klemish <br />Addition plat was that in addition to the 60 foot right-of-way required for T.H. #47, the <br />City required an additional 39 foot wide easement in the event a service road was needed <br />parallel to T.H. g47 at some point in the future. It is not likely that such a service road will <br />ever be constructed and Mr. Muller has requested vacating the 39 foot easement so that the <br />bank structure will not encroach into any public easement. The processing of that vacation <br />of easement request has been initiated, but the City has also identified a need for a trail <br />segment in this area. Refer to Item #8 for additional information on this issue. <br /> <br /> <br />
