Ap~v~ for ~c~ site i~vcmcn~ must ~ ob~M ~m ~c ~ ~ a si~ <br />p~ a~.~ <br /> <br />Observations;: <br /> <br />On September 30, 1993, Mr. Nissen indicated to Staff that because of obligations to consignment <br />clients of the 3)awn shop and for financial masons, it was imperative that the pawn shop open for <br />business at th( new location prior to obtaining site plan approval and installing the required site <br />improvements; Staff agreed that thc pawn shop could open for business and that blacktopping <br />improvcn~nts ;ould be installed prior to sim plan approval to avoid a muddy parking lot during the fall <br />and winter. Ti/~s prior approval was contingent upon Mr. Nissan submitting a site plan apphcation that <br />would includ~ ! he installation of ecmcnt curbing and any necessary corrections to the blacktop installccl <br />based on draim igc patmms. To insure that the site plan approval was properly applied for and that the <br />improvements vould be installed to City standards, Mr. Nisscn would deposit a financial guarantee <br />with the City ir the amount of $4,500, which is an amount equal to 15C~o of thc esrim~texi cost of the <br />required sim improvements. <br /> <br />On or about Ck~ber 1, 1993, the blacktop was installed at 6101 Highway gl0 N.W. and Mr. Nissen <br />had not deposi ~r~d the required financial guarantee with the Oi..ty. <br />On Decemb~ 1~, 1993, Mr. Nissen met with Staff and in~b. ated that because of improvements made <br />to the building ~d site at 610i Highway gl0 N.W., his financial resources were exhausted and he did <br />not have the $4,[~0 financial guarantee. At that time, there was verbal agreement between Mr. Nissen <br />and City Staff that he would make proper application for site plan approval by March 1.5, 1994, and <br />that the balancelof the improvements ancUor any corrections to the existing improvements would be <br />accomplished b! July 30, 1994. In the interim, Mr. Nissen agreed that his pawn shop license would <br />serve as eollate~ for these activities rather than the $4,500 for financial guarani. <br />on Aprii 26, 19~4, Sylvia Frolik sent a letter to Mr. Nissen noting the failure to comply with the <br />March 15th 0e~]ine and requested that he take action immediately for site plan approval in order that <br />the improvemeng could be installed by September 1, 1994. At that time, Ms. !;rolik warned that <br />action to compl~te the site improvements was not taken, there would be a recommendation not to <br />renew his next p~wn shop license application. <br />on September 1~, 1994, Mr. Ralph Nissen submitted his application for site plan approval. This <br />application was r~ceived two weeks after the site improvements were to have been installed, given the <br />second deadline.~.p~Lied by City Staff. Upon review of the sim plan application by the City <br />it was noted thatfthere were certain deficiencies in the application that did not facLlitate a thorough <br />review of the sit~ and proposed improvements. Mr. N~ssen was informed by letter of the additional <br />information tha~ would be required in order to place the" site plan on a subsequent Planning <br />Commission agefida for review. <br /> <br />In October, Mr. iNissen applicd for a renewal of his pawn shop license. Based on thc history <br />described above, the license was issued contingent upon Mr. hr~ssen supplying the $4,500.00 financial <br />guarantee for site Improvements, which he did. <br /> <br /> <br />
