Case ~2: <br /> <br />Request to Rezone Certain Property from B-2 Business and R-1 <br />Rural Residential to R-3 Urban Residential; Case of Anoka Hennepin <br />Independent School District No. 11 <br /> <br />Zoning Administrator Frolik stated that School District No. 11 is in the process of planning an <br />expansion to the Ramsey Elementary School facility, and they have acquired two parcels south of <br />the existing school site to accommodate the expansion. The existing school site is zoned R-1 Rural <br />Residential and the two acquired parcels to the south are zoned B-2 Business, for which schools <br />are nora permitted use. The school is presently considered tawful non-conforming, and to expand <br />a lawful non-conforming use requires a conditional use permit or rezoning. Therefore, School <br />DistriCt No. l 1 is requesting that the property be rezoned to R-3 Urban Residential, for which <br />schools are a permitted use. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to modify the <br />Findi~s of Fact in the affirmative, due to no objection at the public hearing of the matter, and <br />reco~end that City Council adopt these amended Findings of Fact. <br /> <br />Motio~ carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, <br />Holland, and Thomd. Voting No: None. Absent: Commissioners LaDue and Ten3'. <br /> <br />Modoh by Commissioner Deemer and seconded by Commissioner Thorud to recommend that City <br />Coundil ~[pprove the request from Anoka Hennepin Independent School District No. 11 to rezone <br />certaifi;property to R-3 Urban Residential. <br /> <br />MotiOn carried. Voting Yes. Chairperson Bawden, Commissioners Deemer, Thorud, <br />Hen~sen, and Holland. Voting No: None. Absent: Commissioners LaDue and Terry. <br /> <br />Case[4t3: Request for Site Plan Approval; Case of Ralph's Gun and Pawn <br /> <br />Zoning Administrator Frolik stated on December 6, 1994, the. planning Commission tabled action <br />of this case because Mr. Ralph Nissen was not present to respond the the City Staff review letter of <br />11/29i94 which called for the construction of a sump area on the north side of the building and the <br />installation of pavement on the west side of the building if it was going to continue to serve as <br />additional parking area. Ms. Frolik advised that she met with City Engineer Jankowski, <br />Councilmember Kenneth Peterson and Mr. Nissen on December 30, 1994 and the following items <br />were~agreed upon: (1) A temporary sump area measuring 18' x 80' x 3' deep would be <br />cons~cted on the west side of the building. (2) B-612 curbing would be installed along the east <br />and sou h edges of the pavement. No curbing is required in the northwest corner of the <br />drive)parking area to allow run-off to reach the sump area and future expansion of the drive to <br />servid'e the other 3 lots to the west in Guy Addition. Since it is too difficult to install continuous <br />concrete curbing where the existing blacktop meets the existing concrete walkway at the front of <br />the bhilding, it has been recommended that Mr. Nissen be allowed to place the concrete curb <br />secti6ns at the front of the building to prevent cars from driving onto the walkway. (3) Mr. Nissen <br />has agreed that the west side of the building will not be used for parking, and therefore, no <br />additional pavement is required. (4) In accordance with setback requirements in the B-3 Highway <br />Busiffess District, Mr. Nissen has a~eed to cut the blacktop back 17.5 feet from the front property <br />line. ~5) City Staff agreed To re-evaluate the remaining site improvements to be installed and re- <br />calculate the amount of financial guarantee Mr. Nissen is required to provide. Ms. Frolik noted <br />that {his has been reviewed and reduced, and Mr. Nissen will be reimbursed shortly.
