THIS <br /> <br />RAMSEY MEADOWS 3RD ADDITION <br />DEVELOPMENT AGREEMENT <br /> <br /> CITY OF RAMSEY <br />ANOKA COUNTY, MINNESOTA <br /> <br />AGREEMENT, made and entered into by and between the CITY OF <br /> <br /> RA~SEY, a municipal corporation of the State of Minnesota (the." CITY"), and J.A. <br /> MENKVELD & ASSOCIATES, INC., a Minnesota corporation, whose address is 8741 <br /> Central Avenue N.E., Blaine, MN 55434 (the "DEVELOPER"). <br /> ;; WITNESSETH: <br /> ~ WHEREAS, the DEVELOPER is the fee owner of the following described property <br /> situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described <br /> as follows: <br /> Lots 1, 2, 3, and 4, Block I; and Outlot A; Ramsey Meadows 3rd Addition; Anoka <br /> County, Minnesota; and <br /> WHEREAS, on February 28, 1995, pursuant to Resolution No. 95-02- , the CITY <br />approved. the final plat of the Subject Property which plat is known as RAMSEY MEADOWS <br />3R~ ADDITION (the "Plat"), which approval is contingent on certain requirements, including <br />DE~ELOPER and CITY entering into' this Agreement; and <br /> ¢ WHEREAS, the final plat for the Subject Property conforms to the preliminary plat for <br />R~ey Medows approved by the CITY on May 26, 1992; and <br /> ~: WHEREAS, the DEVELOPER herein attests to the fact that there are wetlands existing <br />on tS Subject Property; and <br /> : WHEREAS, the Lower Rum River Water Management Organization approved the <br />Wetland Mitigation Plan dated December 11, 1992; and <br /> ~: WHEREAS, a trunk usage chage is required by the CITY for usage of its Trunk Sewer <br />and _Water System, which charge is $1534 per residential unit created; and <br /> ~ WHEREAS, the DEVELOPER has caused the construction of the following <br />imp{ovements in the Plat without financial participation on the part of the CITY, to-wit: Sanitary <br />sew~, storm drainage fa. cilifie.s, watermains and appurtenances, and streets with concrete curb and <br />gutter, which improvements are termed Stage I Improvements in the City Code ("Stage I <br />Improvements"); and <br /> } WHEREAS, City Code Section 9.50.50 defines "Stage r' Imp~'ovements and "Stage II" <br />Improvements which respective definitions are used herein when reference is made to "Stage I" <br />and '~Stage II" Improvements; and <br /> <br /> I <br /> I <br /> I <br /> I <br /> <br />I <br />I <br />I <br />I <br />I <br />I- <br />I <br />I <br />I <br />I <br />! <br />I <br />I <br />I <br /> <br /> <br />
