I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br /> I <br /> <br /> I <br /> I <br /> i <br /> i <br /> I <br /> <br /> WHEREAS, the DEVELOPER desires to constuct the Stage II improvements, except <br />for those Stage [I Improvements constructed by the CITY. <br /> WHEREAS, no expenditure of CITY funds will be made until the City Code escrow <br />requirements haYe been completed by the DEVELOPER. <br /> <br /> NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />STAtGE I IMPROVEMENTS AND FINANCIAL GUARANTEES: <br /> <br />.City Oode Compliance. That the DEVELOPER will develop the Plat in accordance <br />with thai City Code, Section 9.50, entitled "Subdivision. <br /> <br />Gonfoqmance with Plan. The Plat shall be developed pursuant to the final plat <br />consisting of one (1) sheet, prepared by Caine & Associates Land Surveyors, Inc., entitled <br />Ramse~ Meadows 3rd Addition. <br /> <br />lncor-~-°ration of All City Code Requirements. That the recitals above and the <br />provisions of the City Charter, Subdivision Code, Zoning Code and Public Improvement <br />Code of the CITY, as amended to date hereof, are incorporated herein by reference. <br /> <br />Stage [ Improvements Required. The DEVELOPER has constructed the required <br />Stage Iilmprovements according to the terms and conditions of a previous contract and in <br />accord~ce with DEVELOPERS' plans submitted to the CITY. Said construction was <br />in gen6ral conformance with the Grading and Drainage Plan consisting of one (1) sheet <br />drawn by Kenneth Gust, P.E., dated September 20, 1994. The DEVELOPER shall also <br />be responsible, at its expense, for installation of gas, telephone, and electric utiity <br />improvements. Street lights are the responsibility of the DEVELOPER, however, the <br />CITY 'will arrange for their installation as a Stage II Improvement. The DEVELOPER <br />shall be responsible for completing the rough grading and providing lot comer stakes prior <br />to the installation of underground utilities. <br /> <br />WetlaPd Filling. The DEVELOPER herein agrees that all filling of wetlands shall be <br />completed by June 30, 1995, in accordance with the Wetland Mitigation Plan dated <br />December 11, 1992, and approved by the Lower Rum River Water Management <br />Organization.
