I <br /> I <br /> I <br /> I <br /> I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> , CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT - WHITETAIL MEADOWS <br /> <br />THIS AGREIgMENT, made and entered into by and between the CITY OF RAMSEY, a <br />municipal corpckation of the State of Minnesota (the "CITY"), and LAWRENCE J. FERBER <br />and PAULA I~ERBER, husband and wife, whose address is 17441 Baugh Street N.W., <br />Ramsey, MinneSota ("the DEVELOPERS") <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPERS are the fee owners of the following described <br />property situateJd, in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally <br />described as foUows: <br /> <br />Lots 1 and 2, Block 1, WHITETAIL MEADOWS, Anoka County, Minnesota <br /> <br />the "Subject PrOperty"; and <br /> <br /> WHEREAS, on February 28, 1995, pursuant to Resolution g95-02- , the CITY <br />approved the .final plat of the Subject Property which plat is known as WHITETAIL <br />MEADOWS ~.the "Plat") contingent on certain requirements, including DEVELOPERS and <br />CITY enteringtnto this agreement; and <br /> <br />WHEREAS, the Plat consists of two (2) lots totalling approximately 19.1 acres; <br /> <br /> WHER. EAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (Subd. 2) entitled "Division or Consolidation of Unplatted Lots". <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements h~ive been fulfilled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. Lot !, Block 1, shall retain its existing access onto County Road No. <br />83 and Lot 2, Block 1, shall receive access from County Road No. 83 within thirty (30) <br />feet of the northerly property boundary of Lot 2. The DEVELOPERS and/or their <br />assigns ishall be responsible for removal any trees necessary to cause a safe sight distance <br />for the access from Lot 2 onto County Road No. 83. <br /> <br />Draina~ge and Utility Easements. The standard drainage an.d utility easements around <br />the peril'neter of each of the two lots shall be dedicated to the CITY on the Final Plat. <br /> <br />i <br /> <br /> <br />
